CC Resolution 10517 RESOLUTION NO. 10517 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL GRANTING A PUBLIC UTILITY EASEMENT, EMERGENCY VEHICLE EASEMENT. AND A PEDESTRIAN ACCESS EASEMENT AT 90 SOUTH FIRST STREET (HYDE PARK) AND AUTHORIZING THE PUBLIC WORKS DIRECTOR TO EXECUTE THE EASEMENTS AND ASSOCIATED MAINTENANCE AGREEMENT WHEREAS, on July 15, 2003, the City Council adopted Resolution 10212 granting conditional approval of the Tentative Map for 300 Orchard City Drive; and WHEREAS, on September 21, 2004, the City Council adopted Resolution 10390 approving Tract Map 9591, and the map was subsequently recorded October 7,2004; and WHEREAS, a public utility easement, an emergency vehicle access easement, and a pedestrian access easement are needed by Tower Place Residential, LLC to serve the project; and WHEREAS, prior to granting an easement, City will enter into a maintenance agreement requiring the development to maintain the sidewalk, decorative pavers, lighting and other improvements related to the easement area; and WHEREAS, a legal description and plat depicting the easement to be granted is correctly described in Exhibit A. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell does hereby authorize the Public Works Director to execute the necessary documents to grant the required easements on 90 South First Street (APN 412-07-043), execute a maintenance agreement, and authorizes the City Clerk to record this Resolution.
