CC Resolution 10552 RESOLUTION NO. 10552 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL SUMMARILY VACATING A PUBLIC SERVICE EASEMENT AND A SANITARY SEWER EASEMENT AT 236 N. CENTRAL AVENUE AND AUTHORIZING THE PUBLIC WORKS DIRECTOR TO SIGN A QUITCLAIM DEED WHEREAS, a public service easement and sanitary sewer easement were reserved for public utility purposes, per Tract Map 6662 approved by the City Council on June 8, 1981; and WHEREAS, on July 6, 2004 the City Council adopted ordinance 2048 granting an approval of a zone change to R-1-6 Zoning allowing the development of a single residence; and WHEREAS, the public service easement and sanitary sewer easement are no longer necessary; and WHEREAS, the vacation is to be made pursuant to Chapter 4, Summary Vacation, of Part 3 of Division 9 of the California Streets and Highways Code; and WHEREAS, a legal description and plat depicting the easements to be vacated are correctly described in Attachment 2. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell does hereby vacate the public service easement and sanitary sewer easement at 236 N. Central Avenue (APN 279-40-047), authorizes the Public Works Director to execute the necessary documents for the vacation of these easements, and authorizes the City Clerk to record this resolution. PASSED AND ADOPTED this 2nd day of August, 2005 by the following roll call vote: AYES: Councilmembers: NOES: Councilmembers: ABSENT: Councilmembers: Burr, Hernandez, Furtado, Watson, Kennedy None None APPROVED: ATTEST: Attachment 2 LEGAL DESCRIPTION FOR PUBLIC SERVICE EASEMENT AND SAMITARY SEWER EASEMENT TO BE ABANDONED All that real property situate in the City of Campbell, County of Santa Clara, State of California, being all of that certain Public Service Easement and Sanitary Sewer Easement, as said easements are shown and dedicated on that certain map entitled "Tract 6662," filed for record on June 26, 1981 in Book 486 of Maps at page 46 in the Office of the Recorder of Santa Clara County, and being more particularly described as follows: BEGINNING at a point on the easterly line of North Central Avenue (50' wide), said point being the northwesterly corner of Lot 1, as said lot is shown on said map; thence along the northerly line of said lot South 89°51 '00" East, a distance of 138.30 feet to the northeasterly comer of said lot; thence along the easterly line of said lot South 00°15'00" West, a distance of25.00 feet; thence leaving said line North 89°51 '00" East, a distance of 100.00 feet; thence South 75°31 '24" West, a distance of39.60 feet to the westerly line of said lot and said easterly line of North Central avenue; thence along said line North 00°15'00" East, a distance of35.00 feet to the POINT OF BEGINNING and containing an area of3,649 square feet, more or less.
