SUBJECT:
SUNNYSIDE ALLEY
We have contacted ~e E-Z Foundation Supply Company and
have been assured that th~--wi:U.--J10t allow ~their stored material
to block that portion of the alley from vehicular traffic.
Perhaps the following historical information will be useful
to you in making your report to the City Council:
This issue dates back to the time of the application by
Mr. Deise for his industrial building on Kennedy Avenue--almost
exactly two years ago. Bill Harrison, as his agent, contacted the
residential owners immediately across the alley from the industrial
lot to ask if they had objection to his paving the ten-foot alley
which was half his and half theirs by deed. He also desired to raplace
the old fences along the north side of the alley with something
more attractive. Mr. Cirone and his mother-in-law own two of those
residential lots and both of them denied Mr. Harrison the approval
to accomplish those two actions and thereupon embarked upon a rather
extensive verbal and written campaign with this office to complain
against such an encroachment upon their rights. Mr. Deise sub-
sequently forgot the whole idea and went ahead with the construction
of his building. He leases part of it to the E-Z Foundation Supply
Company (the west end of the building) '-------.

Upon completion of this building, M:<:~oise)negotiated with
the owner to the west of him on Kennedy in t~~terest of purchasing
an additional lot for expansion. That owner,Ken Stringfellow, and he were
unable to ever arrive at an agreed purchase price. Mr. Deise then
negotiated the purchase of the next westerly property and constructed
a building on it. He suggested the same alley treatment to the
abutting residences to the north in the latter case and was able to
accomplish it with their approval. The treatment in question is
exemplified throughout the rear frontage of his parcel in this case.
For better than the last year since Mr. Doise has completed his
industrial buildings, Mr. Cirone has periodically contacted this
office and has complained that Mr. Doise was ~ endeavoring to do him
in--~ven though, to our knowledge, the issue was a dead one with
Mr. Doise. Mr. Cirone was, throughout all this time, in the Army as
a career Master Sergeant and was stationed up north so that all of his

contacts with us were from some distance. He has now retired from
the Army and is making his home locally and is, apparently, still
persisting with this subject. I know of no reason that he should
be concerned with Mr. Doise's plans other than the fact that E-Z
Foundation (the tenant) has, on occasion allowed some of their
stored material to spill out into the alley portion. As I stated
above, we have contacted them, together with Mr. Doise, in the
interest of insuring that this ceases to be a factor.
Mr. Cirone is a special kind of personality as I am sure you
will discover if you ever have an occasion to meet with him. He
is, as a matter of fact, beating a dead horse at the moment. His
mother-in-law is the one, incidentally, who attacked our Surveyor,
Jim Pruitt, with a coffee pot during his surveying activities on
Sunnyside Avenue last year (when we improved it and Kennedy). This
says something for her. Had Cirone been in this area at the time,
I am sure he is a type who would have added the creamer and sugar bowl.
The alley is not used by the garbage people since it is too
narrow and is not continuous beyond the railroad right of way to the
east (they would have to back out).
As to property owner's rights, the alley is owned by each
neighbor to its center line and they each have rights over the entire
alley for access to their rear frontages. There are no public rights
of access beyond that.

to his property.

This letter is being sent to you at the request of Mr. Bill
Harrison or Harrison Realty, 2065 Winchester Boulevard, Campbell,
California.
Mr. Harrison has requested, on your behalf, our permission for
you to pave the alley which lies between Sunnyside and Kennedy
Avenues where it abuts Lots 7, 8, IS, 16, 17 and 18 in Block 2
as the lots are shown upon the map of the Sunnyside Tract.
This office does not object to your request and we give you
permission to pave that area. We want to advise you, however,
that we will hold you liable for'any damage to either public or
private property which occurs as a result of this work and/or for
any injury which may occur du..:ing or. as a result of this work.
Please be advised that this permission to pave the alley does not
and shall not be construed as granting you any right in and to
the alley which you do not already have. You are further advised
that there is an existing sanitary sewer main within the limits of
the alley and there may also be other utilities there of which we
are not aware.

This is to clarify the City's position relative to the
legal status of the subject alleyway.
As previously indicated to you, it is the opinion of the public
works department staff that the alleyway is a public right-of-way.
It follows therefore, that you and/or your neighbors have
no proprietary rights therein.
If further information is required in this regard, you are
advised to research the records of the County Recorder of
the County of Santa Clara and draw your own conclusions from
the information obtained.
The reference for the above opinion is the map of the Sunnyside
Tract as recorded December 15, 1904 and filed in Book K of Maps
at Page 27 in the office of the County Recorder.

Gentlemen:
This is to acknowledge receipt of letter dated May 8,1969
from your Director of Public Works, copy of which is attached
herewith for your information.
It is not the intention of the undersigned to get involved
in a long dialogue concerning the matter in question via mail but
as a citizen and a taxpayer still will exercise my right to take
exception to para.graph 1 of letter of May 8, 1969 for obvious rea-
sons but will not pursue it any further. As to paragraph 2 of this
letter, it ~oes not answer question set forth in underlined section
of paragraph 2, of my letter of 7 April 19b9. It only tends to
confuse us in that it states "Please be advised that it is the opin-
ion of the Public "orks Department staff that you and your wife as
property owners of Parcel No. 413-03-016 at 202 E. Sunnyside Avenue
have no proprietary interest in the alley abutting the southerly
property line of said parce1." This is not very clear inasmuch as
it does not answer what the interest of other property owners might
be. Further, for your information, the address of Parcel No. 413-
04-016 happens to be in error, as it is the address of Mrs. Eliza-
beth Gilson, next door to this parcel, the former owner, who along
Hith the other property owners are also involved.
In hopes of clarifying the misunderstanding which exists on
our part and possibly of those who may be called upon to reply to
this inquiry, the following questions are being put forth:
1. Do TfTe and other property owners both on Kennedy Avenue and
on Sunnyside Avenue have a proprietarJ interest in this alley? (In
letter of May 8,1969 and as quoted above, it is indicated that we
dont (both myself and my wife) but how about the other property
owners, both on Kennedy Avenue and Sunnyside Avenue?)
2. If your answer to 1 above is IINol' as has been already in-
dicated to us, is the City of Campbell going to allow the property
owner 011 Kennedy Avenue (on the southerly side of this alley) to
pave section of alley which abutes on his property and the other
other property of ourselves and others,

If the City of Campbell allows the property owner on

who is going to be responsible for its upkeep and for the cost of
repairing any future excavations which may be made in this aLley?
4. Inasmuch as portion of Kennedy Avenue has been zoned for in-
dustrial purposes, is the City of Caœpbell going to allow this alley
to be used as a public thoroughfare and be used for the purpose of
loading and unloading trucks and other vehicles~
5. If the answer to 4 above is "Yes" it would be appreciated if
we can be advised what document created this easement or situation
and when'?

WHEREAS, there has been submitted to the City Council
by Earl \~. Doise and Zola Doise an agreement for the
development of their real property in accordance with
prescribed conditions; and
WHEREAS, by the terms of said agreement, and concurrently
herewith they have submitted grant deeds of certain portions
of their property for street purposes;
NOW, THEREFORE, BE IT RESOLVED by the City Council
that the Mayor be and he is hereby auü1orized to execute
said agreement on behalf of said City; and
BE IT FURTHER RESOLVED that the grant deed submitted
in connection therewith be and the same is hereby accepted.
