Enclosed, please find a copy of the Planning Commission Resolution No. 2453
approving your application for a Use Permit for an additional living unit
at the above-referenced address. Please review the conditions of approval,
in particular, Condition 12 which requires approval of a fencing and land-
scape plan by the Site and Architectural Review Committee prior to
issuance of a building permit. A copy of the approved plans are also
enclosed.
As you are aware, the City Council, at its meeting of May 21, 1987,
heard an appeal of your application. The Council upheld the Planning
Commission decision approving your project.

PLANNING COMMISSION
BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBELL APPROVING A USE PERMIT
ALLOWING THE CONSTRUCTION OF AN ADDITIONAL
LIVING UNIT ON PROP~RTY KNOWN AS
661 KENNETH AVE. IN AN R-l-lO (SINGLE FAMILY
RESIDENTIAL - 10,000 SO.FT. MINIMUM LOT SIZE)
ZONING DISTRICT. (APPLICATION OF MESSRS. NEILL
SAMS, NEVIN SAMS, AND TOM LANDERS, UP 87-07).
After notification and public hearing as specified by law on the application of
Messrs. Neill Sams, Nevin Sams, and Tom Landers for a Use Permit and approval
of plans and elevations to allow the construction of an additiona living unit
on property known as 661 Kenneth Ave. in an R-I-lO (Single Family Residential -
10,000 sq.ft. minimum lot size) Zoning District, as per the application filed
in the Planning Department on March 12,1987: and, after presentation by the
Planning Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did
find as follows:
1.
The establishment, maintenance or operation of the use applied for will not
be detrimental to the health, safety, peace, morals, comfort or general
welfare of persons residing or working in the neighborhood of such proposed
use, or be detrimental or injurious to property and improvements in the
neighborhood or to the general welfare of the City.
2.
The proposed use is compatible with the uses in the area.
3.
The use is essential or desirable to the public convenience or welfare, and
is in harmony with the various elements or objectives of the City's General
Plan.
4.
With revised plans, the structure will meet all zoning codes of the City.
Based on the above findings, the Planning Commission does hereby grant the
requested Use Permit, subject to the following conditions:
1.
Revised elevations and site plan addressing concerns indicated in the Staff
Report to be submitted to the Planning Department and approved by the
Planning Director upon recommendation of the Architectural Advisor prior to
application for a building permit.
2.
All mechanical equipment on roofs and all utility meters to be screened as
approved by the Planning Director.
3.
All parking and driveway areas to be developed in compliance with Chapter
21.50 of the Campbell Municipal Code. All parking spaces to be provided
with appropriate concrete curbs or bumper guards.

4.
Plans submitted to the Building Department for plan check shall indicate
clearly the location of all connections for underground utilities including

minimum State (Title 25) and local standards as indicated in the Noise
Element of the Campbell General Plan.
6.
The applicant is hereby notified that the property is to be maintained free
of any combustible trash, debris and weeds, until the time that actual
construction commences. All existing structures shall be secured by having
windows boarded up and doors sealed shut, or be demolished or removed from
the property. Sect. 11.201 & 11.414, 1979 Ed. Uniform Fire Code.
PLANNING DEPARTMENT
7.
Prior to occupancy,.applicant to submit proof to the Planning Department of
recordation of deed restriction requiring that not more than one dwelling
unit on the parcel be rented or leased.
8.
No porch or patio area shall be enclosed.
BUILDJNG DEPARTMENT
9.
An unidentified part of sfructure is encoraching into the sideyard
setback. This intrusion to be identified on the construction plans.
PUBLIC WORKS DEPARTMENT
10. Execute an agreement to install street improvements at a future date.
ll. Pay storm drain area fee of $548.00.
FIRE DEPARTMENT
No comments at this time.
PLANNING COMMISSION
12. Fencing and landscaping plan to come back to the Site and Architectural
Review Committee for approval, prior to issuance of a building permit.
The applicant is notified as part of this application that he/she is required
to comply with all applicable Codes and/or Ordinances of the City of Campbell
and the State of California which pertain to this development and are not
herein specified.
