NO. 3)06, AND IMPROVEMENTS THEREON.
~mEREAS, the City Council has been advised by the City
Engineer that all improvements in Tract No. 3906, have been
completed in accordance with those agreements entered into
April 25, 1966 and May 8, 1967, concerning said Tract; and,
WI~EREAS, the City Engineer recommends acceptance of the

WHEREAS, the City of campbell, a municipal corporation of the
state of California, did, by virtue of that certain map of
Tract No. 3906, westmont Estates Unit 1, recorded June 2, 1966,

Recorder of the County of santa Clara, State of California, and
that certain map of Tract No. 4185, WeSbmont Estates Unit 2,

easements, a description of which, together with a map thereof,

WHEREAS, said City Council does find, determine, and affirm
that said public service easements or any parts thereof have
not been used for the purpose for which they were dedicated: and
WHEREAS, said City Council does find, determine, and affirm
that the period during which said public service easements or any
parts thereof have not been used is that certain period fran
June 2, 1966, to May 8, 1967 , inclusive: and
WHEREAS, said City Council does find, determine, and affirm
that said public service easements or any parts thereof are not
necessary for any~esent or prospective public uses: and
WHEREAS, said City Council does hereby elect to proceed in
accordance with the provisions of the Public Service Easement
Vacation Law of the State of California, namely, Title 5, Division
1, Part 1, Chapter 2, Article 5, section 50430, et sequens of the

SECTION TWO:
That it is the intention of the City Council
of the City of Campbell to vacate, abandon,
and close to public use those certain public
service easements, a description of which,
together with a map thereof, is on file in the
office of the City Clerk of the City of Camp-
bell, åt City Hall, 75 North Central Avenue,
Campbell, California.
Notice is hereby given that on Monday
the 12th of June , 1967, at
the hour of 8:00 o'clock PM of said
day, in the City Council Chambers in the City
Hall, 75 North Central Avenue, Campbell,
California, is hereby fixed as the time and
the place for hearing all persons interested
in or having objections to the proposed vacatkn.

SECTION THREE: IT IS HEREBY ORDERED AND DIRECTED that a
copy of this Ordinance be forthwith published
twice, once each week for two successive weeks,
which latter publication shall be made not
less than fifteen (15) days prior to the date
of the hearing, in the Campbell Press, a
newspaper of general circulation, printed and
published in said City of Campbell, and that
notices of the public service easements'
vacation be posted conspicuously along the
line of the easements or parts thereof
proposed to be vacated at least fifteen (l5)
days prior to the date set for the hearing.
Said notice shall be posted not more than
three hundred (300) feet apart, but at least
three (3) such notices shall be posted for
each separate easement. Said notices shall
state the passage of this Ordinance of
Intention and notify of the time, date, and
place of the hearing on the proposed vacation.
SECTION FOUR: That the following is the description of the
public service easement which is proposed to
be vacated:
Those certain public service easements situate
within Tract No. 3906, westmont Estates Unit l, the map of
which Tract No. 3906 was recorded June 2, 1966, and filed
in Book 210 of Maps, at Page 36, in the office of the
County Recorder, County of Santa Clara, State of California,
described as follows:
PARCEL ONE:
That certain public service easement, two (2) feet in width,
contiguous to the easterly line of Lot 24 and within said
Lot 24.

width, contiguous to the common boundary line of Lots 20

Gentlemen:
We have reviewed subject map as related to sanitary sewerage
service and submit the following:
The closest sanitary sewer to this subdivision is in Latimer
Avenue. However, only the lots fronting on Latimer will be able
to connect because of adverse grade conditions. The present
nearest outlet for the remainder of the subdivision is at
Darryl Drive in the City of San Jose. This would require about
1700 feet of six inch line, outside the subdivision limits.
If the configuration of Victor Avenue is tentatively set as
shown it would probably be advisable to Engineer and construct
a line across Hamilton Avenue prior to the Hamilton Avenue
improvement project. Since we have no information on street
patterns farther North on Victor we would probably assume a
street layout to Kendra Way.
Any further information, along with comments and suggestions
will be greatly appreciated.

Gentlemen:
The health department has reviewed the proposed Grattan & Chez sub-
division, located on Latimer Avenue, south of Hamilton Avenue and within the
City of Campbell as shown on a tentative map, submitted to this department dated
September 1964, prepared by Jennings-McDermott Engineering. It is noted that
there are 24 numbered single family residential lots. It is further noted there
is an existing home on lot no. 1 and an existing privy on lot no. 7. Sewage dis-
posal is to be provided by sanitary sewers installed by the subdivider and con-
nected by him to one of the existing trunk sewers of the Santa Clara County Sani-
tation District No.4. The subdivision is in the service area of and shall be
furnished domestic water by the Campbell Water Company.
The existing cesspool on lot no. 1 is to be pumped and backfilled.

The
Final approval of the proposed subdivision is contingent upon the posting
by the subdivider with the Santa Clara County Sanitation District No.4 of an ade-
quate bond to insure completion of sewers as planned. Plans and specifications of
all proposed sewers and appurtenances are to be approved by the Santa Clara County
Sanitation District No.4 prior to recording the final map. Subdivider must agree
to permit no occupancy of any otherwise completed residences until usable sanitary
sewer connections have been effected.
Individual sewage disposal in the proposed subdivision is not approved.

In response to your request for comments on the
tentative map"of a proposed development for Grattan & Chez,
The Campbell Water Co. has one recommendation. In order to
minimize utilrty conflict and to give working room, all streets
with a one side or half development should have a 5' P.U.E.
back of property line on the developed side. This is particular-
ly true in the case of a 56' street where the open parkway may
be smaller than the usual 4t'.
We wish to thank you for the opportunity to comment,
as a utility, on a proposed development. Too often, trouble
occurs when the needs of the utilities have been overlooked.
These troubles can be always resolved, generally speaking, but
usually only after considerable expense and lost time. Pre-
comments is one way to overcome or avoid this.
