This letter is in ~esponse to your June 27, 19~2, letter
requesting approval of minor changes in the site layout
and elevations of PD 71-1 -plans for a 100 unit townhouse
development located south of Latimer Avenue adjacent and
east of the San Tomas Expressway. A review of the plans
submitted reveal the changes to be minor and acceptable
to the departments concerned. The revised plans will be
made part of our records.

Gentlemen:
Reference is hereby made to a certain "Purchase
Agreement and Escrow Instructions" dated May 2, 1972 executed
by the undersigned as Buyer and you as Seller concerning
certain real property described on Valley Title Company Pre-
liminary Report No. S-8277.
Please be advised that the undersigned desires to
enter upon said real property and to remove the existing trees
and to grade said real property in contemplation of the
development of said real property by the undersigned. The
undersigned desires to enter said real property and do the
above work prior to the completion of our purchase of said
real property.
You have advised the undersigned that the undersigned
may enter upon said real property and remove said trees and
grade said real property provided the undersigned hold you
harmless from any loss or liability by reason of the removal of
said trees and the grading of said real property. Therefore,
the undersigned does hereby indemnify and hold you harmless
on account of any damage or loss which you sustain by reason
of the removal of said trees and the grading of said real
property by the undersigned. Said indemnification and agree-
ment to hold you harmless shall include, but not necessarily be
limited to, damages, attorney's fees, and costs involved in any
action which may be brought against you by reason of the removal
of trees and grading of said real property. The undersigned
agrees to pay all claims for labor and all materials promptly
and to secure and keep in force appropriate liability and
property damage insurance concerning the above work being
performed by the undersigned.
The undersigned acknowledges the fact that you will
execute and record a Notice of Non-Responsibility and will post
said re~property appropriately.
