BEING A RESOLUTION AUTHORIZING EXECUTION OF
RELEASE OF AGREEMENT WITH WILLIAM E. HEISS
AND SUNRISE INVESTMENT CO. FOR THE INSTALLA-
TION OF STREET IMPROVEMENTS AT 635 - 669
LATIMER AVENUE
WHEREAS a certain agreement, dated May 22, 1973, and recorded
May 30, 1973, in Book 0 339 of Santa Clara County Official
Records at page 203 et seq, was entered into by and between
William E. Heiss and Sunrise INvestment Co., a Calif. corp. re-
ferred to therein as Owners, and the City of Campbell a
municipal corporation, referred to therein as City, relative
to construction of street improvements across Owners' land
described therein; and
WHEREAS the Owners have fulfilled all the terms and provisions
as contained in said agreement;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Campbell does hereby release Owners, their heirs, suc-
cessors or assigns from all obl igations contained in said
agreement, and terminates said agreement.

Hoque Construction Company
A review of our file shows that P. T. & T. was the only
company requesting the subject 5-foot Public Service
Easement. P. T. & T. has no objections to the proposed
encroachment, and this Department has no indication of
any other proposed or existing use of said easement.
Therefore, this Department finds no objection to said
encroachment.

hydrant @ West Latimer Avenue &
San Tomas Expressway
The plans for the proposed development on West Latimer Avenue at
San Tomas Expressway in the City of Campbell have been reviewed.
The location of the present fi re hydrant, after the street is
re-aligned, wi II be inaccessible to Fire Department equipment.
Would you please contact the Campbell Water Company and make the
necessary arrangements to have tha~ hydrant moved out to the new curb
line.
