PC Res 3698 RESOLUTION NO. 3698 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL RECOMMMENDING APPROVAL OF A ZONING CLASSIFICATION CHANGE (PLN2005-125) FROM M-1-S (LIGHT INDUSTRIAL) TO C-PD (CONDOMINIUM-PLANNED DEVELOPMENT) FOR PROPERTY OWNED BY MR. JAMES CHALMERS LOCATED AT 700-750 E. McGLlNCY LANE. APPLICATION OF MR. CRAIG ALMELEH, ON BEHALF OF ARCHITECTURAL TECHNOLOGIES, INC. FILE NO.: PLN2005-125. After notification and public hearing, as specified by law and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application PLN2005-125: 1. The proposed C-PD zoning designation is consistent with the current Light Industrial General Plan land use designation for the property. 2. The Zoning Code requires that all condominium developments in the City be located within the C-PD Zoning District and the proposed project would change the zoning designation of the property from M-1-S to C-PD to be consistent with this requirement. 3. The project site is located on the south side of East McGlincy Lane, approximately 350 feet west of its intersection with Union Avenue. 4. Projects within the C-PD Zoning District are subject to the procedures set forth in the P-D Zoning District. 5. The zoning designation change from M-1-S to C-PD allows for the separate ownership of units within a multi-tenant building. 6. A Negative Declaration has been prepared for this project concluding that there are no significant impacts associated with this project, pursuant to the California Environmental Quality Act (CEQA). Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: 1. The proposed development and uses will clearly result in a more desirable environment and use of the land than would be possible under any other zoning classification. 2. The development and uses will be compatible with the General Plan of the City and will aid in the harmonious development of the immediate area. 3. The proposed zoning classification change will not be detrimental to the health, safety or welfare of the neighborhood or the City as a whole. There is a reasonable relationship and a rough proportionality between the conditions of approval and the impacts of the project. 5. There is a reasonable relationship between the use of the fees imposed upon the project and the type of development project. 6. No substantial evidence has been presented from which a reasonable argument could be made that shows that the project, as currently presented will have a significant adverse impact on the environment. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission recommends approval of a Zoning Classification Change (PLN2005-125) from M-1-S (Light Industrial) to C-PD (Condominium-Planned Development) for property owned by Mr. James Chalmers located at 700-750 E. McGlincy Lane.
