DISCUSSION
Applicanfs Request: The applicant is requesting approval of a Site and Architectural
Permit to allow an approximately 1700 square foot addition to an existing
commercial building and includes a second story addition. The proposal also
incorporates significant architectural changes to the building elevations.
Background: The site is located on an interior lot on North First Street between
Civic Center Drive and East Campbell Avenue within the Downtown area. The site
is developed with a one story commercial structure of approximately 1500 square
feet and is occupied by a beauty salon and professional offices.
GENERAL PLAN AND ZONING CONSISTENCY
General Plan: The General Plan Land Use designation for this property is indicated
as commercial. The proposed use of the building or offices and service commercial
is consistent with the land use element of the General Plan indicated for this site.
Zoning: The subject property is zoned C-3-S (Central Business) and permits
commercial uses such as offices, retail and service commercial. The existing and
proposed use of the building will continue as offices and service commercial.
The second story addition will provide new office space. The applicanfs proposal is
consistent with the provisions of the Zoning District in terms of uses, height, floor
area ratio (FAR), architectural design, and parking, subject to the conditions of
approval.
ANALYSIS
Use: Office uses will provide compatibility with existing uses in the building and the
surrounding area. The site is bounded by a two story office building to the north
and retail commercial uses to the south. The proposal is in keeping with the goal of
the C-3 Ordinance which encourages a retail orientation and a mix of varied and
complimentary uses in the downtown.
Design: The C-3 Ordinance requires Site and Architectural Approval for new
construction in the downtown. The ordinance emphasizes that additions to existing
buildings be architecturally compatible with the character of the downtown
and incorporate and/or retain important architectural features prominent in the
downtown. The existing design of consists of a simple linear building form with a
shed roof.

The applicant's proposal attempts to incorporate the traditional features of the
downtown by:
· cantilevering the second story addition,
· incorporating projecting reveals,
. the addition of a prominent cornice treatment,
· use of awnings on the second story,
. use of new storefront windows along the front portion of the building
· Use of a belt course between the first and second floors
· Double hung windows
Exterior building materials will consist of stucco stucco. Paint colors are indicated as
a neutral base color with complimentary colors for the trim and awnings. Although
staff is supportive of the proposal, staff has concerns regarding the articulation of the
front portion of the building. Staff recommends that the applicant continue to work
with staff to refine the front of the building to achieve a traditional "retail"
storefront appearance consistent with the downtown policies.
Site Compatibility: Staff had concerns regarding the interface of the two adjacent
buildings, and the view of the north elevation of the proposed second story. The
building north of the project site is setback 25 feet from the front property line. This
results in the prominent visibility of the north elevation of the proposed building
addition. The massing and detailing of this elevation is significant because it is
constructed along the northern property line. Staff has included a condition of
approval requiring the applicant to address this issue by introducing a trellis and/or
other architectural features to enhance the north elevation.
Parking: The parking ratio in the C-3 district requires one parking space for 425
square feet of office area and one parking space of each 345 square feet of retail area.
Based on this ratio the applicant's proposal would require a total of seven (7)
parking spaces. The applicant currently maintains five parking spaces on-site behind
the existing building and utilizes the adjacent parking lot for ingress and egress with
five retail tenants on Campbell Avenue between Second Street and First Street.
However, there is currently no evidence supporting the shared use of these parking
facilities. The applicant has been working with the property owners to resolve this
issue. Staff has included a condition of approval which requires the applicant to
formalize the shared use of the facilities and provide the seven required parking for
this project.

SITE AND ARCHlTECl'URAL REVIEW COMMITIEE
The application was reviewed by the Site and Architectural Review Committee on
May 11, 1995. The Committee was supportive of the expansion and the proposed
architectural changes to the building but recommended that the applicant continue
to work with staff to improve the building articulation of the storefront appearance
of the building.

The Planning Commission finds as follows with regard to file S 94-09:
1. The proposal is consistent with the General Plan and Zoning District which
permits commercial land uses.
2. The proposed project reflects the character of the downtown in terms of
building design, scale and massing, subject to the conditions of approval.
3. The proposed development is in keeping with the goals of the Central Business
Zoning District by enhancing the diversity of uses within the downtown.
4. The proposed architecture and design of the building incorporate the
traditional building form and elements found in the downtown.
5. The proposed development is compatible with the surrounding land uses.
Based upon the foregoing findings of fact, the Planning Commission further finds
and concludes, subject to the Conditions of Approval, that:
1. The establishment, maintenance or operation of the use applied for will not be
detrimental to the public health, safety, peace, morals, comfort or general
welfare of persons residing or working in the neighborhood of such proposed
use, or be detrimental or injurious to property and improvements in the
neighborhood or to the general welfare of the City.
2. The proposed site is adequately served by streets of sufficient capacity, to carry
the kind and quantity of traffic the proposed use would generate.
3. The proposed project is consistent with the General Plan and Zoning of the site
and will aid in the harmonious development of the immediate area subject to
the Conditions of Approval
4. The proposed use is compatible with the uses in the area, subject to the
Conditions of Approval.
CONDITIONS OF APPROVAL FOR FILE NO. S 95-06

The applicant is hereby notified, as part of this application, that he/she is required to
meet the following conditions in accordance with the Ordinances of the City of
Campbell and the State of California. The lead department with which at the
applicant will work is identified on each condition. Additionally, the applicant is
hereby notified that he/she is required to comply with all applicable Codes or
Ordinances of the City of Campbell and the State of California that pertain to this
development and are not herein specified.
1. Project Approval: Approval for this project allows the following:
A. A 1700 square foot second story addition.
B. Elevation changes and architectural modifications.
Plans shall substantially comply with the plans dated May 9, 1995,
prepared by A+ Design and Engineering except for modifications
specified herein.
C Color board shall be approved by the Community Development Director.
D. Approved Use: The use of the building is permitted as follows:
A. Retail/Service Commercial--850 square feet
B. Office-2,325 square feet
2. New Retail Building Elevations
A. Building Design: Applicant shall continue to work with staff on resolving
articulation of building facade along the front portion of the building to
enhance the design of the building including pedestrian level design and
site details in accordance with the downtown policies and design standards
of the C-3-S zoning district. Details may include centering the doorway
and windows on the lower level, and new awning over the lower level
window. Exterior facade details shall be resolved prior to issuance of
building permits.
B. North Elevation: Applicant submit revised elevations to address the
massing and appearance of the north elevation. Revisions may include
the introduction of a trellis element on the masonry wall on the
northern property line, retexturing the masonry wall to match the
proposed building materials, and scoring or revels to enhance the
elevation. Details shall be resolved prior to issuance of building permits.
3. Parking: (A) Applicant shall provide seven (7) parking spaces for the proposed
development. The applicant shall obtain an easement for egress and ingress
over assessors parcels numbers 279-41-039 through 279-41-043 prior to final
occupancy or enter into shared parking agreement with said property owners to

satisfy the parking requirements. (B) Any parking spaces that cannot be
accommodated on site shall be provided off-site as directed by the Redevelopment
Agency. (C) The applicant must demonstrate to the City that all reasonable attempts
have been made to obtain the easement and/or the parking agreement prior to
implementing off-site parking with the Redevelopment Agency. (0) The agreement
with the Redevelopment Agency shall be satisfactory to the City Attorney. All fees
associated with this agreement shall be paid prior to the final occupancy of the
building.
4. Development Schedule: Applicant shall begin construction within one year of
final approval.
5. Tree Protection Plan: Applicant shall provide tree protection plan indicating
trees to be protected and maintained on site during construction.
6. Site Construction
A. Construction and Equipment: Applicant shall utilize construction
equipment which adequately levels the noise in accordance with Section
18.02.030 of the City of Campbell Municipal Code. Construction activity
and construction equipment shall comply with all air quality emission
policies as determined by the Bay Area Air Quality Management District
and the Building Official for the City of Campbell.
B. Construction Hours: Hours of construction shall be limited to 8 a.m. to 5
p.m., Monday through Friday, and 9 a.m. to 4 p.m. Saturdays. No
construction is permitted on Sundays or Holidays.
C. Construction Site:
1. The construction site shall be sprinklered with water, as necessary,
but not less than twice per day, in areas of new construction or
grading where dirt is exposed, to control dust.
2. Haul trucks and material stockpiles shall be covered.
3. The construction area and surrounding areas shall be swept as
necessary, but not less than once daily. All areas shall be adequately
fenced for safety per the Building Official during construction and
demolition.
7. Handicapped Accessibility: All new and remodeled buildings shall provide
handicapped access in accordance with the Uniform Building Code (UBe) and
the Uniform Federal Accessibility Standards (UFAS) and the Federal
Americans With Disabilities Act (ADA).

8. Mechanical Equipment: All roof-mounted and ground-level mechanical
equipment on new or remodel structures on site, which are visible from the
public right-of-way, shall be screened with similar building materials subject to
the approval of the Community Development Director.
9. Garbage Collection: Trash containers of a size and quantity necessary to serve
new or modified building areas shall be located in areas approved by the Fire
Department. Unless otherwise noted, enclosures shall consist of s concrete
floor surrounded by a solid wall or fence and have self-closing doors of a size
specified by the Fire Department. All enclosures to be constructed at grade level
and have a level area adjacent to the trash enclosure area to service these
containers.
10. Fire Sprinkler Protection: Provide an automatic fire sprinkler system
throughout all portions of the building.
11. Second Exit From Second Floor: Provide second exit from second floor level
as occupant load is greater than 10.
12. Alarm Company: If automatic fire sprinkler system is greater than 100 fire
sprinklers, then fire sprinkler system devices shall be monitored by an alarm
company.
13. Underground Utilities: All new utilities provided to the project shall be
underground.
14. Encroachment Permit: Obtain an encroachment permit prior to completing
any work within the public right-of-way.
15. Storm Drainage Area Fee: A Storm Drainage Area Fee shall be paid prior to
the issuance of a building permit. Based on the current fee schedule of #2,340
per acre, the applicant's fee would be $241.02. The fee schedule is subject to
change.
16. Sewer: Ensure that adequate sanitary sewer capacity is provided to the project
site.
17. On-Site and Off-Site Improvements: Anyon-site or off-site improvements
required shall be completed prior to occupancy.

18. Parking: If the applicant proposes to reconfigure and repave the common
parking lot on the adjacent parcels to the south of the subject property as a part
of this project, the following conditions of approval shall be completed:
A. Parking Lot Improvement Plan: Submit to the City Engineer for approval
a Parking Lot Improvement Plan, to be prepared by a registered civil
engineer, showing proposed drainage flows including existing on-site and
off-site drainage systems, any proposed grading, pavement repairs,
overlay, striping, any new curbs or planter areas and any other on-site
parking lot improvements.
B. Permits for Parking Lot Improvements: The applicant shall provide
evidence of authority to obtain permits to construct the proposed parking
lot improvements on the adjacent parcels.
C Reciprocal Ingress and Egress Easements: Reciprocal ingress and egress
easements for use of the common parking lot shall be documented and
recorded with the County Recorder's Office.
D. Curb, Gutter and Sidewalk Installation: Install new curb, gutter and
sidewalk in accordance with the City Standard Details in the location of
the existing driveway, if it is abandoned as part of a new circulation plan.
E. Street Tree: One new street tree shall be planted in the planter strip in
accordance with the City's Standard Specifications.

The Site and Architectural Review Committee (SARC) met on May 11, 1995, to discuss the
following applications and take the following actions:
1. S 95-06 -- 33 N. First Street -- Abbas Ha~hshenas
Applicant is requesting approval of a Site and Architectural application to allow the remodel
and expansion of an existing commercial building to allow a second story addition on this
project site. The Site and Architectural Review Committee was supportive of the applicant's
proposal in concept, subject to the following Conditions:
A. That the applicant investigate further revisions of the street elevation of the building
along N. First Street as well as a further refmement of the pedestrian walkway along
the First Street frontage and the project driveway. Revised elevations to be submitted
for review by staff and the Architectural Advisor.
B. That a condition be imposed to ensure the provision of parking to support the proposed
office expansion. This condition could be addressed through the applicant's
demonstration that he has a right to use the parking areas which are currently provided
adjacent to the development or that the applicant participate in the creation of future
parking spaces within the downtown area that would be created by the Redevelopment
Agency.
2. SA 95-04 -- 2240 S. Winchester Boulevard -- Gene MUWhy
The Site and Architectural Review Committee reviewed the applicant's revised signing
proposal asking approval to reface an existing non-conforming freestanding sign. The Site
and Architectural Review Committee was supportive of the applicant's proposal subject to
the condition that the support structures be painted a similar green color to the trim on the
building and that the smaller miscellaneous signs attached to the freestanding sign be deleted.

As discussed, I have modified the wording of the Public Works Dept. checklist of conditions
for the above project so that they apply specifically to this project and take into account the
possibility of repaving the adjacent parking lot. Many of the conditions in the checklist
appear generic in nature applying more to new subdivisions rather than this specific project.
I tried to adapt the conditions so that they might be more site specific and clearer to the
applicant. I think the modified list attached still addresses Public Works issues as they
pertain to this project.

be incorporated into the CC&R's for the project.
Development and Maintenance Documents:
Shall submit the following documents which demonstrate, to the satisfaction
of the City, that the entire project will be developed and maintained in
accordance with the intent and purpose of the approvals:
a. Final Title Report that guarantees title.
b. Management and Maintenance Agreement to be entered into with the
owners of the project units.
c. Covenants, Conditions and Restrictions (CC&R's) to be recorded.
The approved documents shall be recorded concurrently with the Final Map.
Condition. Covenants and Restrictions:
Submit Covenants, Conditions and Restrictions (CC&R's) to the City for
review, which contain provisions for a Homeowners' Association, to have an
unqualified right to assess owners to individual units for reasonable
maintenance of common areas and improvements.
The Homeowners' Association shall have the right to lien units of the
owners who default in the payment of any assessment so provided. Such lien
shall not be subordinated to any encumbrance. Any deed of trust recorded
prior to said CC&R's shall be subordinated to the CC&R's. Any lien
imposed shall not be superior to any lien for property taxes or government
assessments.

Cause plans, specifications, calculations, and designs for street improvements,

a Civil Engineer or Land Surveyor licensed in the State of California and

X Completion Prior to Occupancy:
Complete construction of all required off-site and on-site improvements,
including but not limited to landscaping, sewer, water, curb and gutters,

DISCUSSION: This proposed building expansion is located near the southwesterly comer of
Civic Center Drive and North First Street (See APN 279-41-38). The applicant wants to add
a second story of 1836 SF to an existing structure of 1465 SF. The improvements in the public
right-of-way generally meet City "standards" for the downtown Campbell commercial section.
The main issue to consider is the existing on-site parking lot as depicted on the Sheet A-I of the
architects plans. Several businesses share a large parking lot. The lot should be improved with
some landscaping and perhaps curbs, gutters, etc. In addition, there is only one undesized drain
connection from the lot to the existing City storm drain in First Street. Item G, on the attached
sheet, summarizes the current City policy regarding this subject. However, we do not
recommend requiring those storm drainage improvements provided the applicant can properly
convey surface water into adjacent curb inlet. In this case, I think the applicant should provide
a preliminary drainage and parking lot improvement plan so we can make a better assessment
of the situation. The parking lot should be upgraded also . We need to discuss this with the
Planning Division in order to agree on the extent of improvements required.
RECOMMENDATION: The Recommended Conditions of Approval are summarized on the
attached sheet.

The Public Works Department has reviewed the above application and the following are our
comments:
A. COMPLETENESS COMMENTS:
1. The plan is incomplete to the extent that it does not show the existing and/or
proposed street rights-of-way of First Street, nor existing property lines. The
plan does not show existing nor proposed onsite or off site improvements nor
existing or proposed utilities, onsite or offsite. The plan does not show existing
or proposed grading and drainage features or facilities. All of the properties
shown, APN279-41-038, 039, 040, 041, and 042 drain toward one single onsite
drain at the southwest comer of this site with a 3 inch diameter conduit to the
flowline of the existing gutter. All of the onsite storm water need to be
collected onsite and conveyed underground to the existing underground public
storm drain system on First Street.
The plan is to be revised to show all of the above. Please see attached
"Development Application Offsite Improvements Checklist", and "Grading and
Drainage Review Checklist" for items required to be submitted for review and
approval.
B. CONDITIONS OF APPROVAL:
1. Aprlicant shall apply for encroachment permit, provide plans, pay fees, post
surety for any construction within the public right of way, including, but not
limited to, irrigation and planting, storm drainage facilities, and public utility
facilities.

Section 9316.1 of the Campbell Municipal Code reads as follows:
Any _approval granted under this section shall expire one hundred eighty
(180) days after the date upon which such approval was granted, unless
an extension for such approval is obtained by making written application
for same to the Planning Commission at least fifteen (15) days prior to
the expiration date of such approval.
No building permit shall be issued after the expiration date of any
approval until a new approval has been obtained in the manner provided
for in this Chapter.
