RESOLUTION NO. 1643
PLANNING COMMISSION
CITY OF CAMPBELL, CALIFORNIA;
After notification and public hearing as specified by law on
the application of Mr. Kenneth Oburn for a use permit and approval of
plans to allow construction of a two-story residence on the rear of
property known as 77 South First Street in a P-D (Planned Development)
Zoning District, as per the application of Hr. Kenneth Oburn filed in
the office of the Planning Director on September 26, 1977 and after
presentation by the Planning Director, proponents and opponents, the
hearing was closed.
After due consideration of all the evidence presented the Commission
did find as follows:
That the establishment, maintenance, and operation of the
proposed use will not be detrimental to the health, safety,
peace, morals, comfort or general welfare of the persons
residing or working in the neighborhood of such use, or
be detrimental or injurious to property and improvements
in the neighborhood or the general welfare of the City.
Based on the above findings, the Planning Commission does hereby
grant the requested use permit subject to the following conditions:
1. Use permit to expire one year after Planning Commission approval.
2. Building to be located a minimum of 10' from the west property
line.
3. Landscape plan Indicating type of plant material, location of
hose bibs or sprinkler system and type of fencing to be submitted
for approval of the Planning Director at time of application for
building permit.
4. Landscaping shall be maintained in accordance with the approved
landscape plan.
5. Faithful performance bond in the amount of $3,000 to be posted
to insure landscaping, fencing and striping of parking area
within three (3) months of completion of construction, or
applicant may file written agreement to complete landscaping,
fencing and striping of parking area prior to final Building
Department clearance.
PASSED AND ADOPTED this 1st day of November, 1977 by the following
roll call vote:
