PD 91-02 was approved by Council on April 19, 1991. The
applicant has not started construction, and wishes to submit a
revised development schedule, extending the PD approval prior to
the PD approval expiration date.
JUSTIFICATIONS FOR CONDITIONS OF APPROVAL:
1. Eliminate conditions #10 and #18. These are conditions
requiring payment of park fees. Since there are two existing
structures on the property and no new dwelling units are being
created, no park fees are due.
3. Amend condition #17 to include pavement of alleyway. Since
the alleyway serves as a driveway access to a garage, an alleyway
approach must be constructed and the alleyway paved.
4. Property owner must maintain the pavement in the alley. This
alleyway was not offered or accepted as a public right of way on
the "Map of the J.H. Campbell Addition to the Town of Campbell -
Book K, Page 29". Therefore, no public maintanance will be
offered for this alleyway.
5. Property owner agree to execute an alley maintenance
agreement with other users of the alley at a future date. Again,
since this is not a public right-of-way, there will be no public
maintenance of the alley. If future property owners wish to
continue to use the alleyway as a secondary access, they must
make private arrangements for the maintenance of the alley.

After notification and Public Hearing as spedfied by law on the application of
Mr. Matt Tollick, for approval of a Planned Development Permit, plans,
elevations, and development schedule to allow the construction of a single-
family home and a residential addition, on property located at 100 South
Second Street, in a PD (Planned Development) Zoning District; and, after
presentation by the City Staff, proponents and opponents, the hearing was
dosed.
After due consideration of all evidence presented, the City Coundl did find
as follows with regard to File No. PD 91-02:
Density: The project density of 6.8 units per gross acre is consistent
with the Low-Medium Density land use which is shown on the
General Plan.

Design: The building massing and architectural style of this project is
compatible to the surrounding residential neighborhood and with the
development policies for the downtown neighborhoods.
Based upon the foregoing findings of fact, the City Council further finds and
concludes that:
The proposed development and uses clearly would result in a more
desirable environment and use of the land than would be possible
under any other zoning classification; and,
o
The development and uses would be compatible with the General Plan
of the City and will aide in the harmonious development of the
immediate area.

development schedule to allow construction of a new single-family home

Subject: 100 S. Second Street/corner of Everett Avenue
You requested information about development of the above property. A previous
parcel map was approved for this site in 1991, together with plans for a house to
replace the rear house. Dedication of right-of-way and street improvements on the
Everett Avenue frontage were a requirement of that approval. The map was never
recorded, and no demolition or construction took place. Due to the length of time
since the approvals, they have lapsed.
Public Works has informed me that either a parcel map to split the parcel in two, or
plans for improvements totaling 50% or more in square footage of either structure
over a five year period would trigger the requirement for street dedication and
improvements. The dedication and improvements would be to achieve 20' of
pavement from the curb to the centerline of the street, plus 5' of sidewalk, and 5' in
an easement behind the sidewalk for required street trees and any future public
utilities.
Architectural improvements or new structures would be required to fit with the
historical architectural styles in the neighborhood.

The City recently approved a Tentative Parcel Map for a two lot subdivision
of the subject property. A condition of that map approval requires the
applicant to execute an agreement to install street improvements on Everett
and Second Streets as directed by the City Engineer.
This memo is meant to serve as a reminder that a lesser street width was
found appropriate at this location due to the traffic levels and the small
number of lots served by Everett Avenue.

Approval of the tentative parcel map PM 91-02 for 100 South
Second Street is recommended for approval with the following
conditions:

PARK FEES:
Park fees of $9,096 (2 units @ $4,548 each) were a
condition of PD approval 92-02. This condition
should not have been placed on the PD since the
proposed development does not contain any
additional residential units.
No park dedication fees should be collected in
connection with the subdivision map.
STORM DRAIN AREA FEES: The storm drain installed on Second
Street was installed with G.O. bonds.
