Category: Consent Calendar Date: September 5, 2000 TITLE: Approval of Parcel Map (PM 99-03) 1418 Abbott Avenue and Acceptance of Public Service Easement (Resolution/Roll Call) RECOMMENDATION That the City Council adopt the attached resolution approving the Parcel Map for property located at 1418 Abbott Avenue and accepting the dedications offered thereon for public service easements. DISCUSSION On November 2, 1999, an Administrative Hearing was held by the Director of Community Development approving a Temative Parcel Map to create four parcels on property located at 1418 Abbott Avenue. The Parcel Map has been prepared, reviewed by staff, and found to be in compliance with the approved Tentative Parcel Map. The public service easements are shown on the map. Conditions of approval for the development include a Street Improvement Agreement requiring the construction of street improvements upon development of the vacant Parcel 3. FISCAL IMPACT There is no fiscal impact associated with this action. ALTERNATIVES Do not approve the Parcel Map. This is not recommended because the Parcel Map is in substantial compliance with the previously approved Tentative Parcel Map. I was expecting the proposed agreement would be consistent with the "Preliminary approval of the Tentative Parcel Map" and the discussions with Steve relative to allowing the work to be done when a Building Permit _ is submitted. I was led to believe that the" Parcel Map" would reflect the work to be required, subject to the possibility of changes to the STANP within 12 months. As I read this proposed document, it does not appear to address the above, and leaves a huge "unknown factor." 1. Page 1, Section (1) ' Since I have not seen the street improvements "...as shown on said Parcel Map.", I can not know what is being committed to. Please forward a readable copy to me. 2. This Section starts out "Prior to the issuance of a building permit .... " Yet, the next paragraph ( first paragraph of Page 2 ) allows the City Engineer to issue the directive to do the work AT ANY TIME. These two items are not consistent. 3. Page 2, paragraph 3: As I recall, the Preliminary Approval specified that the work required would be consistent with the current, existing STANP requirements OR as they may be changed within the next 12 months ( i.e., by Nov. 2, 2000.) Perhaps I'm misreading this paragraph, but it seems to lock the work required to specifically whatever is shown on the" Parcel Map ", which I haven't seen. Is this correct ? HELP 4. Page 3, Section (8): This Section specifically requires installation of a fire hydrant. I thought there was a requirement that there be a hydrant within some specific number of feet .......And I believe there is one directly across the street. If there is, then why the requirement for another ? 7. Page 3, Sections (8) and (9): Why should deposits/bonds be required simply whenever notification is given, as opposed to when needed due to the application for a building permit ? 8. Page 4, Section (11): Why can't the specific work to be required be shown on the "Parcel Map" as submitted, rather than such an open-ended non-specific statement ? 9. I can well understand the reluctance of the Schlaepfer's to sign off on this document. The way it's worded, it entails all the Abbott section from the Northern portion of the Campbell's property to the Southern limit of the Schlaepfer's property. It is so vague that no one can really determine just what must be done. It is guaranteed to result in disagreements, law suits, and costs far exceeding the value of the resulting lot. SUMMARY: I do: not feel that any of the" interested parties" can accept this contract, as currently written. Certainly I do not recommend that my Mother, Wilma Brewer, sign it until modified so as to allow us to understand the potential requirements and associated costs. It is possible that some of my concerns might be addressed upon review of the "Parcel Map" when received. For the most part, there is no intent to modify the intent or result of any portion of the City's version. Nearly every paragraph is identical to the City's version, except where noted. Where any change is intended, I shall specifically identify the proposed change. My intention is to organize and define the agreement in a more clearly defined manner soas to avoid or minimize any possibility of misunderstanding. Partially this is done with Section titles, partially through re-organization of the sequence of items. My notes of explanation are shown within square brackets, i.e., [Note: ...... ], and would NOT be in the agreement to be signed. Also I have used the term" the Owner" when referring to the owner of Parcel 3. Initially this will consist of the Campbells and the Brewers ( excluding the Schlaepfers.) Following any sale of the Parcel 3, it will refer to, and consist solely of, the new owner and his/her successors. However, in the computation of the said twelve-month period, delays due to or caused by acts of God, viz., unusually inclement weather, major strikes, and other delay beyond the control of Owner shall be excluded. It is expressly understood and agreed to that if Owner shall fail to complete the work required by this Agreement within the said 12 month period, the City, after giving ten (10) days written notice thereof to Owner, or successors, may construct and/or install any uncompleted improvements and recover the full cost and expense thereof from the Owner or their successors~ It is further expressly understood that the purpose of this agreement is to defer construction of the specified improvements until some future date more conducive to the overall needs of the City of Campbell. In keeping with this understanding, the right of the City to give any of the notices specified herein to install such improvements, or to require construction or installation of such improvements, or to install such improvements itself and recover the costs thereof shall not be barred by the passage of time or delay by the City, but shall remain open and enforceable indefinitely and forever. Owner, or successors, shall make such deposits or file such bonds and enter into such agreement as required by West Valley Sanitation District to insure the installation of a sanitary sewage system to serve said real property, and Owner, or successors, shall file with City, upon execution of the Public Improvements Agreement [ NOTE: this title is directly fi.om the City's draft contract. Owner, or successors, shall pay to Pacific Gas and Electric Company any and all fees required for installation of underground wiring circuit to all electroliers within said real property when Owner, or successors, is notified by either the City Engineer or the Pacific Gas and Electric Company that said fees are due and payable. Owner, or successors, obligations under this section shall not be relieved by delay or the passage of time, but shall remain binding indefinitely and forever. Owner, or successors, shall make such deposits or file such bonds and enter into such agreement as required by San Jose Water Company when called upon to do so to ensure that installation ora water distribution system to serve said real property, including fire hydrant [ NOTE: If there is currently an existing fire hydrant within the legally proscribed distance from the new Parcel 3, then this requirement for a new hydrant should be deleted.] Owner, or successors, obligations under this section shall not be relieved by delay or the passage of time, but shall remain binding indefinitely and forever. It is provided, however, that in the event eminent domain proceedings are required for the purpose of securing said easement and right-of-way, Owner, or successors, shall deposit or cause to be deposited with City a sum covering the reasOnable market value of the land proposed to be taken and to be included in said sum shall be a reasonable allowance for severance damages, if any. It is further provided that in addition thereto such sums as may be required for legal fees and costs, engineering and other incidental costs shall be deposited with the City. SURETY AND/OR BONDS: Owner, or successors, shall file with City, prior to commencing work, surety, acceptable to City, to ensure full and faithful performance of the construction of all the aforementioned improvement work, excluding sanitary sewers and water distribution system. Said surety shall guarantee that Owner, and successors, will correct any defects which may appear in said improvement work within one (1) year from the date of acceptance of the work by City and pay for any damage to other work resulting from the construction thereof, as well as pay the cost of all labor and materials involved. This surety shall remain in effect until one (1) year after date of final acceptance of said improvements by City. Said surety amount may be reduced by the City Engineer after the date of final acceptance to not less than twenty-five (25) percent of its full value. Upon final release of said surety by City, the obligations of Owner, and successors, contained in this agreement shall be considered null and void. INDEMNITIES: To the fullest extent permitted by law, Owner, and successors, shall indemnify, defend and hold the City of Campbell, the City of Campbell Redevelopment Agency, and its agents, attorneys, employees, officers, officials, and assignees harmless from any and all claims, damages, losses, and expenses, including but not limited to, attorneys fees, arising out of, or resulting from any negligent or intentional act or omission ( including misconduct) of said Owner, or successors, or any subcontractor, or anyone directly or indirectly employed by him, or anyone for whose acts any of them may be liable in the course of performance of this Agreement. Upon completion and acceptance of the improvements by City, Added Parcel Owners, or their successors, shall provide reproducible as-built plans to the City Engineer. -2of 7 - (3) The construction work of the improvements embraced by this Agreement shall be done in accordance with the specifications of the City of Campbell and West Valley Sanitation DistriCt, where indicated. (4) Prior to approval of the plans by the City Engineer pursuant to Sections (2) and (3) of this Agreement, Added Parcel Owners, or their successors, shall pay to the City for examination of improvement plans, field inspection of construction of improvements and all necessary expenses incurred by City in connection with said improvements, a sum to be determined whet said plans are submitted in accordance with the rules in effect at that time. (5) Alded Parcel Owners, or their successors, shall file with City, prior to commencing work, surety, acceptable to City, to ensure full and faithful performance of the construction of ~ 11 the aforementioned improvement work, excluding sanitary sewers and water distribution system. Said surety shall guarantee that Added Parcel Owners, and their successors, will~orrect any defects which may appear in said improvement work within one (1) year from th9 date of acceptance of the work by City and pay for any damage to other work resulting from lhe construction thereof, as well as pay the cost of all labor and materials involved. This gurety shall remain in effect until one (1) year after date of final acceptance of said improvements by City. Said surety amount may be reduced by the City Engineer after the date of final acceptance to not less than twenty-five (25) percent of its full value. (6) Upon final release of said surety by City, the obligations of Added Parcel Owners, and the ir successors, contained in this Agreement shall be considered null and void. These covenants shall be considered to affect rights in the above-described real properties, and shall be bindingon the heirs, assigns, successors, and grantees of Owner to said real property. Description: I believe the three resultine lots all meet every, requirement defined in The San Tomas Area Plan. I can find no instance within the San Tomas Area Neighborhood Plan document which would not be met or exceeded by the New Desired Plan lot and the remainder of the original two current lots. All three ( 3 ) lots will exceed the 10,000 sf requirement; The New Lot will be approximately 13,400 sf in size; None of the existing structures will encroach upon the set-back requirements of any of the new property lines ( other than one existing Storage shed which is planned to be demolished.) Possible Pn ~blem: While not defined in the documents I received from your office, I was told that any new 10,000 sf lot required that some portion of the lot needed to enclose a rectangle with a minimum width of 80 feet, and a length sufficient to provide the 10,000 area. As can be seen on the maps, that property line dividing the two ( 2 ) subject lots from Lot 74, Tract 6030, along the Southerly line IS NOT A STRAIGHT LINE. It consists of three segments, each varying in direction. Thus, ONE SIDE OF THE "RECTANGLE "CAN NOT BE A STRAIGHT LINE PARALLEL WITH IT'S OPPOSITE LINE. As a result, the" rectangle "shown that lies within the proposed new lot has a width that varies from a minimum of approximately 70' to a maximum of approximately 80'. The" rectangle "does enclose approximately 9,000 sf, not the 10,000 sf, but does allow for the design and placement of a home appropriate to the area and definition per the San Tomas Area Neighborhood Plan. Please note on Attachment A, the Assessor's Map of the surrounding area, that the VAST MAJORITY of thc lots do not meet thc 80' width specification. Thus, the Desired Plan provides a New Lot that is totally consistent with the Neighborhood Plan, is larger AND WIDER than most. We therefore request your consideration of this Desired Plan as acceptable. 'his would involve modifying the description of three ( 3 ) existing lots, the third lot owned by a third party who has no interest in the proposal. HE HAS BEEN CONSULTED, AND HAS NO OBJECTION TO THE DEVELOPMENT OF A NEW LOT. While he has NOT taken the position he won't cooperate, he would prefer to not modify his lot and fencing and landscaping. Modifying his property line would involve approval of his mortgage holder ( the Brewer and Campbell lots have no mortgages ), rebuilding of the new fence line, and remodeling of his landscaping. All this added problem / costs would do nothing positive relative to the size or desirability of the new lot, other than to provide a straight property line and to provide the parallel-line for the enclosed "rectangle." Please note, the Assessors Map shows that property lines that are not "straight" and" parallel "are found throughout the area. at the added costs and complexity of this alternate are not justified by any aprovement to the neighborhood. Thus, we request acceptance of the but will attempt to pursue this alternate if it is the only alternative possible.
