PC Res 2832RESOLUTION NO. 2832 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A MODIFICATION TO A SITE AND ARCHITECTURAL REVIEW PERMIT TO ALLOW AN ADDIITION AND REMODEL TO AN EXISTING RESTAURANT ON PROPERTY LOCATED AT 1461 WEST CAMPBELL AVENUE, IN A C-2-S (GENERAL COMMERCIAL) ZONING DISTRICT. APPLICATION OF MR. NELSON HILGER, ON BEHALF OF BAKERS SQUARE. FILE NO. M 92-03 (S 70-19) After notification and Public Hearing as specified by law on the application of Mr. Nelson Hilger, on behalf of Bakers Square, for approval of a modification to a Site and Architectural Review Permit to allow an addition and remodel to an existing restaurant on property located at 1461 West Campbell Avenue, in a C-2-S (General Commercial) Zoning District, as per the application filed in the Planning Department on June 17, 1992; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. M 92-03 (S 70-19). The proposed restaurant expansion is a permitted use in the C-2-S (General Commercial) Zoning District. o The remodelled elevations will enhance the appearance of the restaurant and complement the existing shopping center. o The applicant will refurbish existing landscape areas which will aid in the aesthetic appearance of this project. A parking analysis has been submitted which concludes that existing parking facilities are adequate to serve the proposed expansion. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: The proposed project, subject to the conditions imposed, will be consistent with the general plan; and ° The proposed project, subject to the required conditions, will aid in the harmonious development of the immediate area. Hilger Adopted on November 24, 1992 Page 2 Approval is effective ten days after decision of approval of the Planning Commission, unless an appeal is filed, subject to the following Conditions of Approval: Approved Project: This approval is for a restaurant located on Assessor's Parcel Number 307-50-064. Development shall be in substantial as shown on the project plans listed below, except as modified by the conditions contained herein: A) Architectural plans prepared by Modulus Design Group, Sheets (A0- 1 - A-4) B) Photo perspective. ° Revised elevations to reflect deletion of mansard roof cap for submittal to the Building Division. (Planning) LANDSCAPING 3. Landscaping: Landscaping plan indicating type and size of plant material, and located irrigation system to be submitted to the Planning Department and approved by the Planning Director prior to issuance of a building permit. STREET/SITE IMPROVEMENTS 4. Parking and Driveways: All parking and driveway areas to be developed in compliance with Chapter 21.50 of the Campbell Municipal Code. Parking spaces in front of restaurant, between the two bays only, to be provided with appropriate concrete curbs or bumper guards. (Planning) Signs: Sign application to be submitted in accordance with provisions of the Sign Ordinance for all signs. No sign to be installed until application is approved and permit issued by Planning and Building Departments. (Section 21.53 of the Campbell Municipal Code). (Planning) PROPERTY MANAGEMENT/UTILITIES 6. Garbage Collection: Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single-family dwellings, multiple family dwellings, and all commercial, business, industrial, manufacturing, and construction establishments. Hilger Adopted on November 24, 1992 Page 3 o Trash Containers: Trash container(s) of a size and quality necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence in compliance with Fire Code. All enclosures to be constructed at grade level and have a level area adjacent to the trash enclosure area to service these containers. (Fire) PUBLIC SAFETY/WELFARE 8. Handicapped Requirements: Applicant shall comply with all appropriate State and City requirements for the handicapped. (Building) Underground Utilities: Underground utilities to be provided on-site as required by Section 20.36.150 of the Campbell Municipal Code. (Public Works) 10. Equipment Screening: All mechanical equipment on roofs and all utility meters to be screened for approval by the Planning Director. (Planning) 11. Performance Bond: Applicant to either (1) post a faithful performance bond in the amount of $3000 to ensure landscaping, fencing, and striping of parking areas within 3 months of completion of construction; or (2) provide a written agreement. 12. Sidewalk Width: Minimum finished width of sidewalks is 48". UBC 4406 (Building) 13. Emergency Exits: Exit signage and illumination required at all exterior doors. UBC 3313, 3314 14. Occupancy limit to be approved by the Building Official upon recommendation of the Fire Marshal. (Building) 15. All emergency aisles to allow minimum 44-inch aisle widths. (Fire) 16. Sprinklers: If the building is sprinklered, the system shall be modified to accommodate the new design. (Fire)Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinances for the City of Campbell and the State of California which pertain to this development and are not herein specified.
