PC Res 2828RESOLUTION NO. 2828 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A SITE AND ARCHITECTURAL REVIEW PERMIT TO ALLOW CONSTRUCTION OF AN INDUSTRIAL BUILDING LOCATED AT 184 VEITENHIEMER LANE, IN A M-1-S (LIGHT INDUSTRIAL) ZONING DISTRICT. APPLICATION OF MR. COLIN JAQUES; FILE NO. S 92-04 After notification and Public Hearing as specified by law on the application of Mr. Colin Jaques for approval of a Site and Architectural Review Permit to allow construction of an industrial building located at 184 Veitenhiemer Lane, in a M-1-S (Light Industrial) Zoning District, as per the application filed in the Planning Department on July 29, 1992; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. S 92-04. The proposed building is architecturally compatible with the surrounding area, and is supported by the Architectural Advisor. The parking provided can deficiency adequately serve the proposed use and is supported by Staff and by the Site and Architectural Review Committee. 3. Substantial landscaping to the site enhances the development. Based upon the foregoing findings of fact, the Planning Commission further finds that: 1. The proposed project is consistent with the General Plan and zoning, and o The proposed project will aid in the harmonious development of the immediate area. Approval is effective ten days after decision of approval of the Planning Commission, unless an appeal is filed, subject to the following Conditions of Approval: Approved Project: This approval is for a 4,190 square foot industrial building located at 184 Veitenhiemer Lane. Approval shall substantially conform to the following: Resolution No. 2828 S 92-04 -- 184 Veitenhiemer Lane -- C. Jaques Adopted on November 24, 1992 Page 2 ge o o Project plans prepared by Bruce G. Johnson, Architect, dated October 26, 1992, by the Planning Department and consisting of five sheets, labelled Al-A5. (Planning) Revised Site Plan: Applicant to submit a revised site plan indicating the 18 foot reservation for dedication and revision to the parking layout. (Planning) Signs: Applicant to submit in accordance with the provisions of the Sign Ordinance for all signs. No sign shall be installed until application is approved and permit issued by the Planning and Building Departments. (Section 21.53 of the Campbell Municipal Code). (Planning) Landscaping Plan: Applicant to submit a detailed landscaping plan for approval by the Planning Director upon recommendation by the Landscape Advisor, prior to issuance of building permits. Fencing: Fencing plan indicating location and design details of fencing to be submitted to the Planning Department and approved by the Planning Director prior to issuance of a Building Permit. Trash Containers: Applicant to submit detailed plans of the trash enclosure to the Planning Department, prior to issuance of building permits. Trash container(s) of a size and quantity necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level and have a level area adjacent to the trash enclosure area to service these containers. Equipment Screening: Applicant to submit screening details for all mechanical equipment, subject to approval by the Planning Director. Parking/Paved Areas: All parking and driveway areas to be developed in compliance with Chapter 21.50 of the Campbell Municipal Code. All parking spaces to be provided with appropriate concrete curbs or bumper guards. Bond: Applicant to either (1) post a faithful performance bond in the amount of $3000 to ensure landscaping, fencing, and striping of parking areas within 3 months of completion of construction; or (2) file a written Resolution No. 2828 S 92-04 -- 184 Veitenhiemer Lane -- C. Jaques Adopted on November 24, 1992 Page 3 agreement to complete landscaping, fencing, and striping of parking areas. Bond or agreement to be filed with the Planning Department prior to application for a Building Permit. 10. Use of Right-of-Way: The applicant shall demonstrate that Veitenhiemer Lane is constructed in such a way as to withstand the potential traffic generated by the proposed use at this property. Any portions of Veitenhiemer Lane which are insufficient must be improved so as to withstand this traffic. (Public Works) 11. Garbage Collection: Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all commercial, business, dwellings, multiple apartment units; to all commercial, business, industrial, manufacturing, and construction establishments. 11. Dedication: The applicant shall make an irrevocable offer of dedication of 18 feet along the Veitenhiemer Lane frontage of his property. This offer of dedication will be accepted by the City at such time that Veitenhiemer Lane becomes a public street. (Public Works) 12. Street Improvements: The applicant shall sign a deferred street improvement agreement for the improvement of the Veitenhiemer Lane frontage of the property. (Public Works) 13. Grading and Drainage: Submit grading and drainage plans satisfactory to the City Engineer. (Public Works) 14. Fire Code: Fire sprinkler protection is required throughout the building. (Fire) 15. Fire Code: The vehicle parking area shall be separated from the remainder of the building by a one hour occupancy separation. (Fire) 16. Occupancy Requirements: Parking motor vehicles inside the proposed structure results in a "B-I" occupancy, a one hour (1-hr) separation from the "B-2" (office) occupancy, and specific ventilation requirements. (Building) 17. Maintenance: The applicant is hereby notified that the property is to be Resolution No. 2828 S 92-04 -- 184 Veitenhiemer Lane -- C. Jaques Adopted on November 24, 1992 Page 4 maintained free of any combustible trash, debris and weeds, until the time that actual construction commences. All existing structures shall be secured by having windows boarded up and doors sealed shut, or be demolished or removed from the property. Section No. 11.201 and 11.414, 1979 Ed. Uniform Fire Code. 18. Building Code: Maximum of 125 lbs/sq, ft. loading permitted on loft. (Building) 19. Utilities and Transformers: Applicant to submit a letter to the Planning Department, prior to installation of PG&E utility (transformer) boxes, indicating the location of the boxes and screening (if boxes are above ground) for approval of the Planning Director. Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinances for the City of Campbell and the State of California which pertain to this development and are not herein specified.
