BEING A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CAMPBELL APPROVING A MODIFICATION TO
THE SIDE YARD SETBACK REQUIREMENT TO ALLOW A 6 FOOT
AND AN 8 FOOT SETBACK FOR A SECOND STORY ADDITION
ON PROPERTY LOCATED AT 1719 VILLARITA DRIVE IN A R-l-6
(SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT. FILE NO.
M 92-08
After notification and public hearing as specified by law on the application of
Mr. and Mrs. Ron Jennings, approving a modification to the side yard setback
requirement to allow a 6 foot and an 8 foot setback for a second story addition
on property located at 1719 Villarita Drive in a R-l-6 (Single Family
Residential) Zoning District, as per the application filed in the Planning
Department on September 25, 1992; and, after presentation by the City Staff,
proponents and opponents, the hearing was closed.
The Planning Commission finds as follows with regard to Planning
Application No. M 92-08:
The proposed addition is well integrated and incorporates building
materials that are consistent with the existing dwelling.

The proposed addition meets the intent of the Zoning Ordinance
allowing a five foot side yard setback for a second story addition.
3. The adjacent neighbors are supportive of the proposal.
Based upon the foregoing findings of fact, the Planning Commission finds
and concludes that:
That the said side yard will not be detrimental to the health, safety, peace,
comfort, or general welfare of persons in the neighborhood or the City as
a whole, and
That said side yard will not unreasonably interfere with the ability of
adjoining property owners who enjoy access to sunlight, air, privacy, and
quiet enjoyment of such owner's property.
Approval is effective ten days after decision of approval of the Planning
Commission, unless an appeal is filed. The applicant is notified as part of this
application that he is required to comply with the following Conditions of
Approval:

MODIFICATION APPROVAL
1. Approved Project: The approval is granted for a minor modification to
the side yard setback requirement allowing a second story addition with a
6 foot side yard setback to the western property line, and an 8 foot setback
to the easterly property line.
SITE
AND BUILDING DESIGN
Approved Plans: Approval of the minor modification allows a 1,244
square foot second story addition and a 198 square foot first floor
addition. The property is identified as Assessor's Parcel Number 307-15-
029.
A. Project drawings for the addition consist of 6 sheets prepared by
Detail Inc., dated August 28, 1992.
BUILDING CODE
3. Building Permits: Obtain all necessary building permits prior to
construction.
Engineering Calculations: A licensed engineer's calculations are
required for approval of a second story residential addition.
Further, the applicant is notified as part of this application that he is required
to comply with all applicable Codes and Ordinances of the City of Campbell
and the State of California which pertain to this development and are not
herein specified.
PASSED AND ADOPTED this 10th day of November, 1992, by the following
roll call vote:
