PC Res 2825RESOLUTION NO. 2825 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A CONDITIONAL USE PERMIT TO ESTABLISH AN OFF-SALE LIQUOR STORE IN CONJUNCTION WITH A PREVIOUSLY APPROVED DRUG STORE AT 1660 SOUTH WINCHESTER BOULEVARD IN A C-1- S (NEIGHBORHOOD COMMERCIAL) ZONING DISTRICT. APPLICATION OF MR. PASQUALE ZAMBRENO, ON BEHALF OF WALGREENS COMPANY, FILE NO. UP 92-14. After notification and Public Hearing as specified by law on the application of Mr. Pasquale Zambreno establishing an off-sale liquor store in a C-1-S (Neighborhood Commercial) Zoning District, as per the application filed in the Planning Department on September 15, 1992; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission finds as follows with regard to Planning Application No. UP 92-14: The use is compatible with the existing and proposed uses in the general vicinity. o The site provides adequate on-site parking to service the proposed retail use. o The site provides adequate landscaping and screen wall buffers to adjacent residential uses. The main entrance to the proposed use is located along South Winchester Boulevard frontage. The proposed use represents a minor portion of the proposed drug store square footage. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: The establishment, maintenance, or operation of the use applied for will not be detrimental to the health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. Resolution No. 2825 adopted by the Planning Commission on November 10, 1992 Page 2 o The proposed site is adequate in size and shape to accommodate the yards, walls, fences, parking and loading facilities, landscaping and other development features required in order to integrate said use with uses in the surrounding area. ge The proposed site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic such use would generate; 4. The proposed use is compatible with the uses in the surrounding area. Approval is effective ten days after decision of approval by the Planning Commission, unless an appeal is filed, subject to the following Conditions of Approval: USE PERMIT 1. Permitted Use: The use permit is to allow a general off-sale liquor license in conjunction with 14,000 square foot drug store. (Planning) a) Hours of Operation 9:00 a.m. to 10:00 p.m., Monday through Saturdays 10:00 a.m. to 8:00 p.m., Sundays Square Footage: The square footage of the proposed liquor sales to be limited to 1,600 square feet of alcohol beverage area and 440 square feet of alcohol beverage stock area. Liquor Licenses: The applicant shall obtain a general off-sale liquor license and comply with all necessary requirements set forth by the Department of Alcoholic Beverage Control. (Planning) Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified.
