BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBELL, STATE OF CALIFORNIA,
APPROVING A MODIFICATION TO A PREVIOUSLY
APPROVED SITE AND ARCHITECTURAL PERMIT (S 86-19)
ALLOWING ADDITIONAL OFFICE SPACE IN AN EXISTING
OFFICE/WAREHOUSE BUILDING, FOR PROPERTY
LOCATED AT 786 McGLINCEY LANE, IN A M-1-S (LIGHT
INDUSTRIAL) ZONING DISTRICT; APPLICATION OF MR.
THOMAS SPARLING, ON BEHALF OF CAL-PAC ROOFING,
FILE NO. M 92-07 (S 86-19).
After notification and Public Hearing as specified by law on the application of Mr.
Thomas Sparling, on behalf of Cai Pac Roofing, approving a modification to a
previously approved Site and Architectural Permit allowing additional office space
in an existing office/warehouse building, for property located at 786 McGlincey Lane,
in a M-1-S (Light Industrial) Zoning District, as per the application filed in the
Planning Department on September 20, 1992; and, after presentation by the City Staff,
proponents and opponents, the hearing was closed.
The Planning Commission, City of Campbell, finds as follows, with regard to
File No. M 92-07, for a Modification from the City Zoning Ordinance:
1. The site plan provides adequate on-site parking to serve the use.
2. The proposed changes to the elevations will enhance the appearance of the
building.

The Planning Commission has previously approved minor changes to parking
ratios for similar building proposals.
Based upon the foregoing findings of fact, the Planning Commission further
finds and concludes that:
The establishment, maintenance, or operation of the use applied for will not be
detrimental to the health, safety, peace, morals, comfort or general welfare of
persons residing or working in the neighborhood of such proposed use, or be
detrimental or injurious to property and improvements in the neighborhood or
to the general welfare of the City.

The proposed site is adequate in size and shape to accommodate the yards, walls,
fences, parking and loading facilities, landscaping and other development
features required in order to integrate said use with uses in the surrounding
area.
3. The proposed site is adequately served by streets of sufficient capacity to carry the
kind and quantity of traffic such use would generate;
Approval is effective ten days after decision of approval of the Planning
Commission, unless an appeal is filed. The applicant is notified as part of this
application that he is required to comply with the following Conditions of Approval:
MODIFICATION APPROVAL
1. Project Approval: Approval is granted for a Modification to S 89-19 allowing a
revised space utilization plan as indicated on the floor plans and site plans dated
October 2, 1992 and as detailed below: (Planning)
Approved Office Area: 1700 square feet
Approved Warehouse Area: 1900 square feet
Net Building Area: 3600 square feet
Number of Parking Spaces: 10

Building Requirements: Applicant to secure all necessary building permits for
an occupancy change from warehouse to office use and for the interior
designated parking space as detailed on the approved plans. (Planning)

Occupancy: Parking of motor vehicles within the building results in a change of
occupancy in that portion of the building from a Group B, Division 2 occupancy
to a Group B, Division 1 occupancy which is a more hazardous use. U.F.C.
Section 10507 (c) 2 as amended by the Fire Department, requires fire sprinkler
protection when the use is changed to a more hazardous occupancy group.

Fence Plan: Applicant to submit a revised fence plan indicating the removal of
the fence located across the driveway entrance and/or relocation of the fence to
the roll-up door.

Approved Building Use: Is limited to an office/showroom/warehouse
occupancy for a roof contracting business.

Further, the applicant is notified as part of this application that he is required to
comply with all applicable Codes and Ordinances of the City of Campbell and the
State of California that pertain to this development and are not herein specified.
