PC Res 2813RESOLUTION NO. 2813 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A CONDITIONAL USE PERMIT ALLOWING A DRIVE-THROUGH FOR AN EXISTING FAST FOOD RESTAURANT, ON PROPERTY LOCATED AT 1450 WEST CAMPBELL AVENUE, IN A C-2-S (GENERAL COMMERCIAL) ZONING DISTRICT, APPLICATION OF MRS. VIRGINIA FANELLI, FILE NO. UP 92-10. After notification and Public Hearing as specified by law on the application of Mrs. Virginia Fanelli, filed on June 17, 1992, for approval of plans and elevations to allow a drive-through service at an existing fast-food restaurant, on property located at 1450 West Campbell Avenue, in a C-2-S (General Commercial) Zoning District; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. UP 92-10: 1. The proposal is consistent with the General Plan and Zoning for the area. 2. The parking defidency of two spaces is not considered significant, since a substantial portion of the business is comprised of the drive-through service. Based upon the foregoing findings of fact, the Planning Commission further inds and concludes that: 1. The establishment, maintenance, or operation of the use applied for will not be detrimental to the public health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. 2. The proposed site is adequate in size and shape to accommodate the yards, wall, fences, parking and loading facilities, landscaping and other development features required in order to integrate said use with uses in the surrounding area. 3. The proposed site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic such use would generate. 4. The proposed use is compatible with the uses in the area. Resolution No. 281 ~ Planning File No. UP 92-10 Adopted: September 22, 1992 page two Based upon the above findings, the Planning Commission does hereby grant the requested proposal, subject to the following Conditions of Approval: USE PERMIT APPROVAL Approved Project: The Site and Architectural approval is granted for an expansion/remodel of a Jack-in-the-Box restaurant located at 1450 West Campbell Avenue, APN: 404-01-002, site plans and elevations prepared by Foodmaker, Inc., dated June 16, 1992. The color board is on file in the Planning Department. Use Permit: The use allowed is for a 2,444 square foot fast-food restaurant with drive-through service. (Planning) a. Number of Seats 45 b.
