BEING A RESOLUTION OF THE PLANNING
COMMISSION OF THE CITY OF CAMPBELL,
APPROVING A MODIFICATION TO A PREVIOUSLY
APPROVED USE PERMIT 88-01 TO ALLOW A
SECOND OPERATING ROOM FOR THE FACILITY
LOCATED AT 3777 SOUTH BASCOM AVENUE, IN A
R-3-S (MULTIPLE-FAMILY RESIDENTIAL) ZONING
DISTRICT; APPLICATION OF MR. STEVEN
NIELSEN, FILE NO. M 92-06 UP 88-01).
After notification and Public Hearing as specified by law on the application of
Mr. Steven Nielsen, on behalf of Recovery Inn of Los Gatos, approving a
modification to a previously approved Use Permit to allow an additional
operating room, in a R-3-S (Multiple-Family Residential) Zoning District, as
per the application filed in the Planning Department on July 9, 1992; and, after
presentation by the City Staff, proponents and opponents, the hearing was
closed.
After due consideration of all evidence presented, the Planning Commission
did find as follows with respect to File No. M 92-06 (UP 88-10):
The proposed addition does not significantly change the character or
intensity of the existing use.
The presented building addition is consistent in design with the existing
building.
3. Adequate on-site parking has been provided.
Based upon the foregoing findings of fact, the Planning Commission further
finds and concludes that:
The establishment, maintenance, or operation of the modification to
the use applied for will not be detrimental to the health, safety, peace,
morals, comfort or general welfare of persons residing or working in
the neighborhood of such proposed use, or be detrimental or injurious
to property and improvements in the neighborhood or to the general
welfare of the City.
The proposed site is adequate in size and shape to accommodate the
yards, walls, fences, parking and loading facilities, landscaping and
other development features required in order to integrate said use with
uses in the surrounding area.

The proposed site is adequately served by streets of sufficient capacity to
carry the kind and quantity of traffic such use would generate; and,
4. The proposed use is compatible with the uses in the area.
Approval is effective ten days after decision of approval of the Planning
Commission, unless an appeal is filed.
Further, the applicant is notified as part of this application that he is required
to comply with the following Conditions of Approval:
Approved Project: This approval is for an operating room addition
located on a 37,730 square foot site identified as Assessor's Parcel
Numbers 414-44-001 & 002. Development shall be substantially as shown
on the project materials listed below, except as may be modified by
conditions contained herein: (Planning)
a. Project drawings for Recovery Inn of Los Gatos prepared by Dennis
Hogan consisting of 4 sheets, dated June 23, 1992.
STREET/SITE IMPROVEMENTS
2. Parking and Driveways: All parking and driveway areas to be developed
in compliance with Chapter 21.50 of the Campbell Municipal Code. All
parking spaces to be provided with appropriate concrete curbs or bumper
guards. (Planning)

Handicapped Requirements: Applicant shall comply with all appropriate
State and City requirements for the handicapped. (Building)
o
Underground Utilities: Underground utilities to be provided as required
by Section 20.36.150 of the Campbell Municipal Code. (Public Works)

Equipment Screening: All mechanical equipment on roofs and all utility
meters to be screened for approval by the Planning Director. (Planning)

Building Permit Review: Provide the percentage of outpatient services
to inpatient services for determining jurisdiction of the project.

Project Approval: Project approval is valid for one year from the date of
Planning Commission approval. (Planning)
o
Trash Enclosure: In the event that the present trash enclosure location
adversely effects the neighboring residential uses, the applicant shall
relocate the trash enclosure area in a location and manner as approved by
the Planning Director.
Further, the applicant is notified as part of this application that he is required
to comply with all applicable Codes and Ordinances of the City of Campbell
and the State of California that pertain to this development and are not
herein specified.
