PC Res 2809RESOLUTION NO. 2809 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL, STATE OF CALIFORNIA, APPROVING A MODIFICATION TO A PREVIOUSLY APPROVED PLANNED DEVELOPMENT PERMIT TO ALLOW A RESIDENTIAL ADDITION, FOR PROPERTY LOCATED AT 1239 BRACEBRIDGE COURT, IN A PD (PLANNED DEVELOPMENT/LOW- MEDIUM DENSITY RESIDENTIAL) ZONING DISTRICT; APPLICATION OF MR. DAN WINKLEBLECK, ON BEHALF OF MS. ROBIN SEGARINI, PLANNING FILE NO. M 92-01 After notification and Public Hearing as specified by law on the application of Mr. Dan Winklebleck, on behalf of Ms. Robin Segarini, approving a modification to a previously approved Planned Development Permit to allow a residential addition for property located at 1239 Bracebridge Court, in a PD (Planned Development, Low- Medium Density Residential) Zoning District, as per the application filed in the Planning Department on May 20, 1992; and, after presentation by the City Staff, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. M 92-01 (ZC 77-16): The proposed addition will not substantially alter the original character or design of the existing development. 2. The proposed design integrates well with the existing structure. o The proposed modification will not result in a condition contrary to the intent of the Planned Development Ordinance. o The addition will enhance the appearance of the structure and will provide a measure to resolve deficiencies in the existing design. The proposed addition will not substantially diminish the view of the adjacent property owner. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: Resolution No. 2809 adopted by the Planning Commission on July 28, 1992 page two o The proposed development and uses clearly would result in a more desirable environment and use of land than would be possible under any other zoning classification. The development and uses would be compatible with the General Plan of the City and will aid in the harmonious development of the immediate area. The proposed development would not be detrimental to the health, safety or welfare of the neighborhood or the City as a whole. Further, the applicant is notified as part of this application that he is required to comply with the following Conditions of Approval: 1. Approved Plan: Approval is granted for a 280 square foot residential addition on the dwelling located at 1239 Bracebridge Court. 2. Building Permit: Obtain all necessary building permits prior to construction. 3. Fire Separation: Fire separation must be maintained at property lines and between garage and second floor. Approval is effective ten days after decision of approval of the Planning Commission, unless an appeal is filed. Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified.
