PC Res 2804Resolution No. 2804, adopted June 9, 1992 by the Planning Commission pase I RESOLUTION NO. 2804 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL, STATE OF CALIFORNIA, RECOMMENDING APPROVAL OF REINSTATEMENT OF A PLANNED DEVELOPMENT PERMIT, A REVISED DEVELOPMENT SCHEDULE, AND CONDITIONS OF APPROVAL TO ALLOW CONSTRUCTION OF A NEW SINGLE-FAMILY DWELLING AND A RESIDENTIAL ADDITION ON PROPERTY LOCATED AT 100 SOUTH SECOND STREET, IN A PD (PLANNED DEVELOPMENT) ZONING DISTRICT. APPLICATION OF MR. MATTHEW TOLLICK, FILE NO. R 92-05 (PD 91-02). After notification and Public Hearing as specified by law on the application of Mr. Matthew Tollick, for approval of Reinstatement of a previously approved Planned Development Permit, and Revised Development Schedule to allow construction of a new single-family dwelling on property located at 100 South Second Street, in a PD (Planned Development) Zoning District; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with regard to File No. R 92-05: 1. There have been no changes in the General Plan for this area since the City Council's approval. 2. The project remains consistent with the General Plan designation of Low/Medium Density Residential. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: The proposed development and uses clearly would result in a more desirable environment and use of land than would be possible under any other zoning classification. Resolution No. 2804, adopted June 9, 1992 by the Planning Commission page 2 The development and uses would be compatible with the General Plan of the City and will aid in the harmonious development of the immediate area. 3. The proposed development would not be detrimental to the health, safety or welfare of the neighborhood or the City as a whole. Based upon the above findings, the Planning Commission recommends approval of the Reinstatement of the Planned Development Permit and Revised Development Schedule, subject to the following Conditions of Approval: Revised Plans and Elevations: Revised elevations indicating a revised east elevation of new residence addressing roof treatments/changes and a 5 foot monolithic sidewalk, per City standards along the Everett Avenue street frontage to be submitted to the Planning Department and approved by the Planning Director upon recommendation of the Architectural Advisor prior to application for a building permit. (Planning) Landscaping: Landscaping plan indicating type and size of plant material, and located irrigation system to be submitted to the Planning Department and approved by the Site and Architectural Review Committee prior to issuance of building permit. (Planning) Proper .ty Maintenance: The applicant is hereby notified that the property is to be maintained free of any combustible trash, debris and weeds, until the time that actual construction commences. All existing structures shall be secured by having windows boarded up and doors sealed shut, or be demolished or removed from the property. Section 11.201 & 11.414, 1985 Ed. Uniform Fire Code. (Fire) Garbage Collection: Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single-family dwellings, multiple apartment units, to all commercial, business, industrial, manufacturing, and construction establishments. Trash Containers: Trash container(s) of a size and quality necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing Resolution No. 2804, adopted June 9, 1992 by the Planning; Commission pa~e 3 doors of a size specified by the Fire Department. All enclosures to be constructed at grade level and have a level area adjacent to the trash enclosure area to service these containers. (Fire) Parking and Driveways: All parking and driveway areas to be developed in compliance with Chapter 21.50 of the Campbell Municipal Code. All parking spaces to be provided with appropriate concrete curbs or bumper guards. (Planning) 7. Handicapped Requirements: Applicant shall comply with all appropriate State and City requirements for the handicapped. (Building) o Fences: Fencing plan indicating location and design details of fencing to be submitted to the Planning Department and approved by the Planning Director prior to issuance of a building permit. (Planning) 9. Retaining Walls: Retaining walls at property lines are limited to a height of 15 inches if constructed of wood. (Building) 11. Performance Bond: Applicant to either (1) post a faithful performance bond in the amount of $3000 to ensure landscaping, fencing, and striping of parking areas within 3 months of completion of construction; or (2) file a written agreement to complete landscaping, fencing and striping of parking areas. Bond or agreement to be filed with the Planning Department prior to application for a building permit. (Planning) 12. Public Occupancy: Building occupancy will not be allowed until public improvements are installed. (Public Works) 13. Underground Utilities: Underground utilities to be provided as required by Section 20.36.150 of the Campbell Municipal Code. (Public Works) 14. Utility Boxes: Applicant to submit a plan to the Planning Department, prior to installation of PG&E utility (transformer) boxes, indicating the location of the boxes and screening (if boxes are above ground) for approval of the Planning Director. Utility Connections: Plans submitted to the Building Division for plan check shall indicate clearly the location of all connections for underground utilities including water, sewer, electric, telephone and television cables, etc. (Building) 16. Noise Levels: Noise levels for the interior of residential units shall comply with minimum State (Title 25) and local standards as indicated in the Noise Element of the Campbell General Plan. 17. Street Improvements: Dedicate additional right-of-way to widen Everett Avenue to 30 feet from centerline with a 20' radius return. Install standard street improvements on Everett Avenue and on Second Street and pave alleyway for driveway access to garage, as directed by the City Engineer. Obtain an excavation permit, pay fees and post surety for all work in the right-of-way, prior to obtaining the building permit. 19. Grading and Drainage: Submit a grading and drainage plan, prior to obtaining the building permit. 20. Parcel Map: Process and file a parcel map to create the two lots, prior to obtaining the building permit. 21. Demolition Permit: Obtain demolition permit to remove structures and a sewer cap. 22. Building Code Compliance: Comply with all adopted Codes and laws. New address 232 Everett Avenue fits in with local addresses. 23. Property owner must maintain pavement in alleyway. 24. Property owner to agree to execute an alley maintenance agreement with other users of the alley at a future date.
