PC Res 2800RESOLUTION NO. 2800 CITY OF CAMPBELL PLANNING COMMISSION BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL, CALIFORNIA, RECOMMENDING APPROVAL OF A PLANNED DEVELOPMENT PERMIT, PLANS, ELEVATIONS, DEVELOPMENT SCHEDULE, AND CONDITIONS OF APPROVAL TO ALLOW CONSTRUCTION OF A NEW DWELLING UNIT, ON PROPERTY LOCATED AT 346 NORTH CENTRAL AVENUE, IN A R-M-S (MULTI-FAMILY RESIDENTIAL) ZONING DISTRICT. APPLICATION OF MR. CHAN-YONG PAK, PLANNING FILE NO. PD 92-01. After notification and Public Hearing as specified by law on the application of Mr. Chan-Yong Pak, for approval of a Planned Development, plans, elevations, and development schedule to allow construction of a new dwelling unit, on property located at 346 North Central Avenue after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with regard to File No. PD 92-01: o The proposed Planned Development Permit is consistent with the Land Use Element of the General Plan. The proposed density of 8.8 units per gross acre is consistent with the General Plan land use designation of 6-13 units per gross acre and is no greater than would be allowed in the R-M-S (Multi-Family) Zoning District. The project massing and design is consistent with other developments in the surrounding area and is consistent with the development policies of downtown residential neighborhood. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: The proposed development and uses clearly would result in a more desirable environment and use of land than would be possible under any other zoning classification. 2. The development and uses would be compatible with the General Plan of Planning Commission Resolution No. 2800 May 12. 1992 Pal~e 2 the City and will aid in the harmonious development of the immediate area. The proposed development would not result in allowing more residential units than would be allowed by other residential Zoning Districts which are consistent with the General Plan designation of the property. The proposed development would not be detrimental to the health, safety or welfare of the neighborhood or the City as a whole. Based upon the above findings, the Planning Commission recommends approval of the plans, elevations, development schedule, and Conditions of Approval as presented; and, further recommends that the City Council approve a Planned Development Permit and enact the attached Resolution adopting said plans, elevations, development schedule, and conditions of approval for that portion of the above-referenced Planned Development District. (Planning) o Parcel Map: Process and file a final parcel map. Previous dedication of street right-of-way to 30 feet from centerline of Central Avenue was not officially recorded. Dedication of right-of way to 30 feet from centerline will be required on parcel map. (Public Works) o Property Line: Relocate property line along the southerly elevation adjacent to the common driveway, so that it is located three feet south of the building. (Planning) PROPERTY MANAGEMENT / UTILITIF. S 8. Utility Boxes and Back-Flow Preventers: Applicant to submit a plan to the Planning Department, prior to the installation of PG&E utility (transformer) boxes and San Jose Water black-flow preventers, indicating the location of the boxes and screening (if boxes are above ground) for approval by the Planning Director. (Planning) Utility Connections: Plans submitted to the Building Division for plan check shall indicate clearly the location of all connections for under- ground utilities including water, sewer, electric, telephone and television cables, etc. (Building) 10. Utility Meters: One set of meters must be provided for each parcel per City Ordinance. (Building) 11. Underground Utilities: Underground utilities to be provided as required by Section 20.36.150 of the Campbell Municipal Code. (Public Works) 12. Proper _ty Maintenance: The applicant is hereby notified that the property is to be maintained free of any combustible trash, debris and weeds, until the time that actual construction commences. All existing structures shall be secured by having windows boarded up and doors sealed shut, or be demolished or removed from the property. Section 11.201 & 11.414, 1985 Ed. Uniform Fire Code. Garbage Collection: Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single-family dwellings, multiple apartment units, to all commercial, business, industrial, manufacturing, and construction establishments. (Fire Department) PUBLIC SAFETY/WELFARE 14. Storm Drain Fee: Pay storm drain area fee of $352. (Public Works) 15. Grading and Drainage: Provide three sets of grading and drainage plans for the City Engineer's review. (Public Works) 16. Performance Bond: Applicant to either (1) post a faithful performance bond in the amount of $3,000 to ensure landscaping, fencing, and striping of parking areas within 3 months of completion of construction; or (2) file a written agreement to complete landscaping, fencing and striping of parking areas.
