PC Res 2783RESOLUTION NO. 2783 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A CONDITIONAL USE PERMIT ALLOWING A RETAIL CENTER FOR WATERCRAFTS AND MOTORCYCLES, ON PROPERTY LOCATED AT 2092 SOUTH WINCHESTER BOULEVARD, IN A C-2-S (GENERAL COMMERCIAL) ZONING DISTRICT; APPLICATION OF MR. MARK MOONEY, ON BEHALF OF MOTORS WEST, FILE NO. UP 91-23. After notification and Public Hearing as specified by law on the application of Mr. Mark Mooney, on behalf of Motors West, allowing a retail center for watercrafts and motorcycles, on property located at 2092 South Winchester Boulevard, in a C-2-S (General Commercial) Zoning District, as per the application filed in the Planning Department on November 27, 1992~ and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. UP 91-23: The proposed retail use is located in a C-2-S (General Commercial) Zoning District that allows the sale of watercrafts and motorcycles as a permitted use subject to the approval of a Conditional Use Permit. The use will be located within an existing commercial building and will not expand the current non-conformance aspect of the use in regard to the parking and landscaping. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: The establishment, maintenance, or operation of the use applied for will not be detrimental to the public health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. The proposed site is adequate in size and shape to accommodate the yards, walls, fences, parking and loading facilities, landscaping and other development features required in order to integrate said use with uses in the surrounding area. Resolution No. 2783 adopted by the Planning Commission on February 25, 1992 page two o The proposed site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic such use would generate. 4. The proposed use is compatible with the uses in the area. Approval is effective ten days after derision of approval of the Planning Commission, subject to the following conditions, unless an appeal is filed: Approved Project: This approval is for the establishment of a retail sales center for motorcycles and watercrafts on a site identified as Assessor's Parcel Number 412-05-050. Development shall substantially conform to the applicant's description and plans submitted as a portion of the application. This approval does not allow for any outdoor display area or service area on this parcel. o Hours of Operation: Hours of operation are to be limited to 9:00 a.m., until 9:00 p.m., Monday through Friday and 9:00 a.m., until 6:00 p.m., on Saturdays and Sundays. (Planning) o Building Permits: Applicant to obtain any necessary Building Permits for proposed tenant improvements. (Building) o Awning: The material for the awning must be fade resistent and a sample of both the material and color must be submitted to the Planning Department for approval prior to installation. (Planning) o Landscape: Landscape plan to be submitted to the Planning Department for approval by the Planning Director prior to the issuance of building permits. Planters: The landscape planter must be built out of masonry material. (Planning) o Drainage Plan: A drainage plan must be submitted for review by the City Engineer. (Public Works) o Ingress/Egress Easement: The applicant shall record a covenant obligating existing and future property owners to participate in a reciprocal access easements with all of the properties located on the ease side of Winchester Boulevard between Rincon and Sanford Avenues. Said easements shall be implemented at such time as said property owners are obligated to participate in a similar agreement, and upon determination by the City of Campbell that implementation of said easements is in the public interest. o Trash Enclosure: Prior to building occupancy, the applicant shall provide a screened trash enclosure area acceptable to the Planning Director, and the Fire Marshall. (Fire) Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinance of the City of Campbell and the State of California which pertain to this development and are not herein specified.
