BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBELL APPROVING A
k CONDITIONAL USE PERMIT ALLOWING AN OFF-SALE
LIQUOR LICENSE IN AN EXISTING RETAIL BUILDING, ON

After notification and Public Hearing as specified by law on the application of
Mr. Alan Cot~, allowing an off-sale liquor license in an existing retail
building, located at 75 South San Tomas Aquino Road, in a C-1-S
(Neighborhood Commercial) Zoning District, as per the application fried in
the Planning Department on December 13, 1992; and, after presentation by the
Planning Director, proponents and opponents, the hearing was dosed.
After due consideration of all evidence presented, the Planning Commission
did find as follows with respect to File No. UP 91-24:
The proposed use conforms to the land use designation of the General
Plan allowing commerdal use and the C-1-S (Neighborhood
Commerdal) Zoning District.
2. The Police Department has no objection to the establis,hment of a
liquor sales operation on the subject property.
3. The applicant has operated a similar operation for the past 30 years
with similar proximity to residential uses.
4. Limited hours of operation will reduce traffic impacts associated with
the use.
5. The establishment of the operation will not increase the number of
liquor establishments in the area since the applicant is relocating the
business.
Based on the foregoing findings of fact, the Planning Commission further
finds and concludes that:

#2 1. The establishment, maintenance, or operation of the use applied for
will not be detrimental to the public health, safety, peace, morals,
comfort or general welfare of persons residing or working the
neighborhood of such proposed use, or be detrimental or injurious to
property and improvements in the neighborhood or to the general
welfare of the City.
The proposed site is adequate in size and shape to accommodate the
yards, wall, fences, parking and loading facilities, landscaping and other
development features required in order to integrate said use with uses
in the surrounding area.
3. The proposed site is adequately served by streets of sufficient capacity to
carry the kind and quantity of traffic such use would generate.
4. The proposed use is compatible with the uses in the area.
Based upon the above findings, the Planning Commission does hereby grant
the requested Conditional Use Permit, subject to the following Conditions of
Approval:
Use Permit: The use allowed is for a 2,400 square foot liquor store.
Type of License: General liquor sales.
Permitted: Off-sale liquor sales.
Prohibited: On-site consumption.
Prohibited: Coin operated amusement devices.

Hours of Operation:
Monday through Saturday - 10:00 a.m. - 9:00 p.m.
Sunday - 10:00 a.m. - 8:00 p.m.

Landscaping: Landscaping plans indicating type and size of plant material
and location of irrigation system to be installed along the La Pradera Drive
and San Tomas Aquino Road frontages and shall be submitted to the Site
and Architectural Review Committee for approval. The landscaping
improvements shall be installed prior to occupancy. (Planning)

Trash Enclosure: Applicant to submit a plan for a trash enclosure. The
enclosure shall consist of a concrete floor surrounded by a solid wall or
fence and have self-closing doors of a size specified by the Fire Department
and have a level area adjacent to the trash enclosure area to service the
container. (Fire)
Sound Attenuation: Air conditioners and air compressors to be
appropriately screened to attenuate noise. The screening plans to be

submitted to the Site and Architectural Review Committee for approval.

Ingress and Egress: The applicant shall be responsible for installing traffic
control devices which will allow only left turns into the site and right
turn movements out of the driveway on La Pradera Drive. The driveway
configuration shall be referred to the Site and Architectural Review
Committee. Additionally, the applicant shall work with the Public Works
Department to evaluate the feasibility of shortening the median island on
San Tomas Aquino Road to potentially allow left turn access into the site
from northbound San Tomas Aquino Road.
Easements: The applicant shall demonstrate existence of reciprocal
ingress/egress easements and/or agree to provide such easements at such
time that neighboring property owners are obligated to participate in a
similar agreement upon determination by the City of Campbell.
Approval is effective ten days after decision of approval of the Planning
Commission, unless an appeal is filed.
Further, the applicant is notified as part of this application that he is required
to comply with all applicable Codes and Ordinance of the City of Campbell
and the State of California which pertain to this development and are not
herein specified.
