BEING A RESOLUTION OF THE PLANNING
COMMISSION OF THE CITY OF CAMPBELL
RECOMMENDING APPROVAL OF A TENTATIVE
PARCEL MAP TO CREATE TWO PARCELS, ON
PROPERTY LOCATED AT 176 EAST RINCON AVENUE,
APPLICATION OF MR. JOE PUCCI, IN A PD (PLANNED
DEVELOPMENT) ZONING DISTRICT. PLANNING FILE
NO. PM 91-07.
After public notification, as spedfied by law, for the application of Mr. Joe
Pucci for approval of a Tentative Parcel Map to create two parcels, on property
located at 176 East Rincon Avenue, Assessor's Parcel Number 413-06-064, as
per the application filed in the Planning Department on July 24, 1991; and
after presentation by the Planning Director, the Planning Commission did
find, with regard to File No. PM 91-07:
The General Plan allows a density range of 6-13 dwelling units per acre
on the subject site.
2. The proposal will result in a density of 9.5 dwelling units per acre.
3. The proposed parking meets the requirements of the Parking Ordinance.
The conditions of approval require an agreement for the joint
maintenance of access areas.
Based on the foregoing findings of fact, the City Council further finds and
concludes that:
The proposed development would clearly result in a more desirable
environment and use of land than would be possible under any other
zoning classification.
The proposed development would be compatible with the General Plan
of the City, and will aid in the harmonious development of the
immediate area.
The proposed development will not result in allowing more residential
units than would be allowed by other residential zoning districts which
are consistent with the General Plan designation of the property.

The proposed development would not be detrimental to the health,
safety, or welfare of the neighborhood or of the City as a whole.
The proposed additional living unit is compatible with the surrounding
neighborhood.

The project is consistent with the Development Polices for downtown
residential neighborhoods contained in Ordinance No. 1797.

STREET AND SITE IMPROVEMI~NT$
The applicant shall record an appropriate deed restriction and covenant
running with the land assuring existing and future property owners ingress
and egress easements to parking areas located in the rear of the site. Said
covenants shall be placed in escrow and recorded simultaneously with the
transfer of ownership at no cost to the City. A draft of the covenant shall be
submitted for review and approval of the Planning Department and City
Attorney prior to recordation. The covenant shall be recorded prior to
issuance of building permits. (Planning)
The applicant shall record an appropriate covenant running with the land
requiring existing and future property owners to jointly maintain the
common driveway area. Said covenants shall be placed in escrow and
recorded simultaneously with the transfer of ownership at no cost to the
City. A draft of the covenant shall be submitted for review and approval
of the Planning Department and City Attorney prior to recordation. The
covenant shall be recorded prior to issuance of building permits.

engineering design costs and instan improvements to the alley located to
the rear of the subject property, at a date to be determined by the City.
Said covenants shall be placed in escrow and recorded simultaneously
with the transfer of ownership at no cost to the City. A draft of the
covenant shall be submitted for review and approval of the Planning
Department and City Attorney prior to recordation. The covenant shall be
recorded prior to issuance of building permits. (Planning)
The applicant is required to process and file a parcel map creating the two
parcels. (Public Works)
