PC Res 3509 RESOLUTION NO. 3509 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE C1TY OF CAMPBELL GRANTING A SIGN EXCEPTION (PLN2003- 65) TO ALLOW THE INSTALLATION OF TWO NEW GROUND SIGNS ON PROPERTY OWNED BY EQUITY OFFICE LOCATED AT 1995 S. BASCOM AVNUE IN A C-2-S (GENERAL COMMERCIAL) ZONING DISTRICT. APPLICATION OF MR. GARY MILLHOLLEN, ON BEHALF OF PRUNEYARD INN. FILE NO. PLN2003-65. After notification and public heating, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application PLN2003-65. 1. The proposed signs are architecturally compatible with the building in terms of color, style and design and would be constructed of high quality durable materials. 2. The proposed sizes of the ground signs are proportional in size to the new low walls. 3. The site is unusually difficult to locate in comparison to similar uses due to the location of the building to the rear of the existing retail pad building along South Bascom Avenue. The business would not be adequately identified with only one wall sign and a freeway oriented sign due to the distance of the building to the street frontage, its orientation, and the size of the building. 5. The project qualifies as Categorically Exempt under Section 15311, Class 11 of the California Environmental Quality Act (CEQA) pertaining to accessory structures. Based on the foregoing findings of fact, the Planning Commission further finds and concludes that: 1. The proposed sign is consistent with the purposes of the Sign Ordinance by preserving and improving the visual character of the community. 2. The use for which the sign is to be erected would not be adequately identified in comparison to similar uses without exceeding the standards of the Sign Ordinance. 3. The proposed sign would not be detrimental to the public welfare or persons in the neighborhood or the City as a whole and allows for reasonable business identification. 4. The proposed signs will promote the economic viability of the City by providing adequate identification and visibility of the business, and will also best serve the public welfare and be in keeping with the principles and purposes of the City's Sign Ordinance. Bascom Avenue - Sign Exception - Pruneyard Inn Page 2 o No substantial evidence has been presented from which a reasonable argument could be made that shows that the project, as currently presented and subject to the required Conditions of Approval, will have a significant adverse impact on the environment. 6. There is a reasonable relationship and a rough proportionality between the Conditions of Approval and the impacts of the project. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission approves a Sign Exception (PLN2003-65) to allow two new ground signs on property owned by Equity Office located at 1995 S. Bascom Avenue, subject to the following conditions: Where approval by the Director of Community Development, City Engineer, Public Works Director, City Attorney or Fire Department is required, that review shall be for compliance with all applicable conditions of approval, adopted policies and guidelines, ordinances, laws and regulations and accepted engineering practices for the item under review. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. COMMUNITY DEVELOPMENT DEPARTMENT Planning Division: Approved Plans: Approval is granted for a Sign Exception to allow the installation of two new ground signs to be attached to the low wall at the main hotel entrance and the low wall where Campisi Way and the northern driveway access intersect on property located at 1995 S. Bascom Avenue. The sign design and location submitted for building permits shall substantially conform to the project plans received by the Planning Division on May 14, 2003, prepared by Patti Merker Architects, including a site plan, sign design, and elevations. Building Division: o Permits Required: A building permit application shall be required for the proposed signs. The building permit shall include Electrical/Plumbing/Mechanical fees when such work is part of the permit.
