PC Res 2775RESOLIYrION NO. 2775 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL, APPROVING A MODIFICATION TO A PREVIOUSLY APPROVED USE PERMIT FOR EXPANSION OF THE PARKING AREA, A MODULAR STORAGE, AND A NEW DRIVEWAY, FOR PROPERTY LOCATED AT 251 LLEWELLYN AVENUE , IN A PF (PUBLIC FACILITIES) AND A PD (PLANNED DEVELOPMENT) ZONING DISTRICT; APPLICATION OF MR. DAN HUNSAKER, ON BEHALF OF STOWERS AND ASSOCIATES/ARCHITECTS, FILE NO. M 91-12. After notification and Public Hearing as specified by law on the application of Mr. Dan Hunsaker, on behalf of Stowers and Associates/Architects, approving a modification to a previously approved Use Permit to allow an expansion to the parking facilities, a module storage building, and a new driveway, in a PF (Public Facilities) and a PD (Planned Development) Zoning District, as per the application filed in the Planning Department on October 9, 1991; and, after presentation by the City Staff, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. M 91-12: Based upon the foregoing findings of fact, the Planning commission further finds and concludes that: The proposed parking expansion is consistent with the General Plan and Zoning for this site. The provision of additional access and increased parking improves on-site circulation and improves the on-site parking supply. o The modular building design with modifications is considered acceptable and compatible to existing uses on the site. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: Resolution No. 2775 adopted by the Planning Commission on November 26, 1991 page The establishment, maintenance, or operation of the use applied for will not be detrimental to the health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. The proposed site is adequate in size and shape to accommodate the yards, walls, fences, parking and loading facilities, landscaping and other development features required in order to integrate said use with uses in the surrounding area. The proposed site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic such use would generate. 4. The proposed use is compatible with the uses in the area. Approval is effective ten days after decision of approval of the Planning Commission, unless an appeal is filed. Further, the applicant is notified as part of this application that he is required to comply with the following Conditions of Approval: Approved Project: This approval is for a parking area expansion located on at 251 Llewellyn Avenue, identified as Assessor's Parcel Number 305-17-007. Development shall be substantially as shown on the project materials listed below, except as may be modified by conditions contained herein: (Planning) a. Project drawings for Eastfield Ming Quong prepared by Stowers Associates, Architects, Inc., consisting of 2 sheets, dated July 25, 1991. b. Color board on-file in the Planning Department. Module Walls: Provide 1-hour exterior walls if modular is less than 20 feet from another structure or property line. Openings are not permitted less than 5 feet from structure or property line, and openings protected less than 10 feet from structure or property line. The property line requirement may be waived with recorded easement and written Building Division approval. (Building) Landscaping: Landscaping plan indicating type and size of plant material, and located irrigation system to be submitted to the Planning Department and approved by the Planning Director prior to issuance of a building permit. The landscape plan shall indicate 24 inch box tree sizes, and a landscape screen along San Tomas Expressway. (Planning) o o 10. 11. 12. 13. 14. Resolution No. 2775 adopted by the Planning Commission on November 26, 1991 page Parking and Driveways: All parking and driveway areas to be developed in compliance with Chapter 21.50 of the Campbell Municipal code. All parking spaces to be provided with appropriate concrete curbs or bumper guards. All employees shall be required to park on-site. (Planning) Street Improvements: Applicant to obtain excavation permit, post surety and pay fees to install new driveway as required by the traffic Engineer. (Public Works) Traffic Control: Applicant to adjust traffic control facilities, if necessary, as required by the Traffic Engineer. (Public Works) Drainage: Applicant to provide a grading and drainage plan for approval of the City Engineer. (Public Works) Driveway Width: The driveway shall not be less than 20 feet wide at any point. (Fire) Curbs: Curb on the north property line shall be painted red and marked "No Parking- Fire Lane." (Fire) Trash Containers: Trash container(s) of a size and quality necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level and have a level area adjacent to the trash enclosure area to service these containers. (Fire) Dumpster Enclosure: The dumpster enclosure size may need to be evaluated do to recycling equipment. (Fire) Handicapped Requirements: Applicant shall comply with all appropriate State and City requirements for the handicapped. (Building) Utility Boxes and Back-Flow Preventers: Applicant to submit a plan to the Planning Department, prior to installation of PG&E utility (transformer) boxes and S.J. Water back-flow preventers, indicating the location of the boxes and screening (if boxes are above ground) for approval of the Planning Director. (Planning) Utility Connections: Plans submitted to the Building Division for plan check shall indicate clearly the location of all connections for underground utilities including water, sewer, electric, telephone and television cables, etc. (Building) Resolution No. 2775 adopted by the Planning Commission on November 26, 1991 page 15. Performance Bond: Applicant to either (1) post a faithful performance bond in the amount of $3,000 to ensure landscaping, fencing, and striping of parking areas within 3 months of completion of construction; or (2) file a written agreement to complete landscaping, fencing and striping of parking areas. Bond or agreement to be filed prior to application for a building permit. (Planning) Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified.
