PC Res 2773RESOLU~ON NO. 2773 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL, FOR APPROVAL OF A MODIFICATION TO A PREVIOUSLY APPROVED SITE AND ARCHITECTURAL APPLICATION ALLOWING THE REMODEL AND EXPANSION OF AN EXISTING RESTAURANT LOCATED AT 1555 SOUTH BASCOM AVENUE IN A C-2-S (GENERAL COMMERCIAL) ZONING DISTRICT; APPLICATION OF MR. NELSON HILGER, HPC ARCHITECTURE, FILE NO. M 91-09. After notification and Public Hearing as specified by law on the application of Mr. Nelson Hilger, HPC Architecture, approving a modification to a previously approved Site and Architectural application, in a C-2-S (General Commercial) Zoning District, as per the application filed 'in the Planning Department; and, after presentation by City Staff, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. M 91-09: The proposed restaurant use is a permitted use in the C-2-S (General Commercial) Zoning District. o The presented site plan provides adequate parking and on site landscaping to serve the proposed use. The architectural design has been found to be acceptable by the City's Architectural Advisor. o The project site is adequately served by public streets and on-site circulation to handle the anticipated vehicular traffic associated with the proposed use. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: 1. The proposed project, subject to the conditions imposed, will be consistent with the General Plan; and o The proposed project, subject to the required conditions, will aid in the harmonious development of the immediate area. Resolution No. 2773 Adopted October 8, 1991 Page 2 Approval is effective ten days after decision of approval of the Planning Commission, unless an appeal is filed. Further, the applicant is notified as part of this application that he is required to comply with the following Conditions of Approval: SITE AND BUILDING DESIGN 1. Revised Plans: Revised site plan indicating increased landscape areas, elimination of two parking spaces along the rear property line, and new or refurbished rear fencing to be submitted to the Planning Department and approved by the Planning Director upon recommendation of the Architectural Advisor prior to application for a building permit. (Planning) o Approved Project: This approval is for a restaurant located on Assessor's Parcel Number 282-24-010. Development shall be substantially as shown on the project plans listed below, except as may be modified by conditions contained herein: (Planning) a. Project drawings for Spoon's restaurant prepared by HPC Architecture consisting of Sheets A-1 through A-4 dated August 15, 1991. b. Color board on-file in the Planning Department. LANDSCAPING 3. Landscaping: Landscaping plan indicating type and size of plant material, and located irrigation system to be submitted to the Planning Department and approved by the Planning Director prior to issuance of a building permit. Landscaping plan to include expanded landscaping areas as required by Condition #1. (Planning) STREET/SITE IMPROVEMENTS 4. Parking and Driveways: All parking and driveway areas to be developed in compliance with Chapter 21.50 of the Campbell Municipal Code. All parking spaces to be provided with appropriate concrete curbs or bumper guards. (Planning) o Fences: Fencing plan indicating location and design details of new or refurbished fencing along westerly property line to be submitted to the Planning Department and approved by the Planning Director prior to issuance of a building permit. (Planning) Resolution No. 2773 Adopted October 8, 1991 Page 3 Signs: Sign application to be submitted in accordance with provisions of the Sign Ordinance for all signs. No sign to be installed until application is approved and permit issued by Planning and Building Departments (Section 21.53 of the Campbell Municipal Code). (Planning) PROPERTY MANAGEMENT/UTILITIES 7. Garbage Collection: Ordinance No. 782 of the Campbell Munidpal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single-family dwellings, multiple family dwellings, and all commercial, business, industrial, manufacturing, and construction establishments. (Fire) Trash Containers: Trash container(s) of a size and quality necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level and have a level area adjacent to the trash enclosure area to service these containers. (Fire) PUBLIC SAFETY/WELFARE 9. Handicapped Requirements: Applicant shall comply with all appropriate State and City requirements for the handicapped. (Building) 10. Underground Utilities: Underground utilities to be provided as required by Section 20.36.150 of the Campbell Municipal Code. (Public Works) 11. Equipment Screening: All mechanical equipment on roofs and all utility meters to be screened for approval by the Planning Director. (Planning) 12. Performance Bond: Applicant to either (1) post a faithful performance bond in the amount of $3000 to ensure landscaping, fencing, and striping of parking areas within 3 months of completion of construction; or (2) file a written agreement to complete landscaping, fencing and striping of parking areas. Bond or agreement to be filed prior to application for a building permit. (Planning) 13. Fire Lanes: Provide fire lanes along the north and south elevation of the building. (Fire) Resolution No. 2773 Adopted October 8, 1991 Page 4 14. Building Occupancy: Building shall comply with CCR, Title 19 and Title 24 for a Group A Division 3 occupancy. (Fire) 15. Occupancy Limit: Maximum occupant load is 270 (A3 occupancy). (Building) 16. Exits: Provide exit illumination and exit signage for a clear path of egress. UBC 3313, UBC 3314.
