PC Res 2772RESOLUTION NO. 2772 BEING A RESOLUTION OF THE PLANNING COMMI.qqlON OF THE CITY OF CAMPBELL APPROVING A CONDITIONAL USE PER_MIT ALLOWING THE MOVE-ON OF AN EXISTING RESIDENCE TO PROPERTY LOCATED AT 690 SOUTH SAN TOMAS AQUINO ROAD, IN A PD (PLANNED DEVELOPMENT) ZONING DISTRICT; APPLICATION OF MRS. LOUISE PEREZ, FILE NO. UP 91-18. After notification and Public Hearing as specified by law on the application of Mrs. Louise Perez allowing the move-on of an existing residence to property located at 690 South San Tomas Aquino Road, in a PD (Planned Development) Zoning District, as per the application filed in the Planning Department on August 6, 19911 and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. UP 91-18: The architectural style of the proposed structure provides appropriate massing and appearance that will complement the neighborhood. 2. The design of the driveway allows for safe ingress and egress. o The provision of two covered parking spaces and two uncovered spaces satisfies the parking requirements for the proposed use. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: The establishment, maintenance, or operation of the use applied for will not be detrimental to the public health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. The proposed site is adequate in size and shape to accommodate the yards, walls, fences, parking and loading facilities, landscaping and other development features required in order to integrate said use with uses in the surrounding area. o The proposed site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic such use would generate. Resolution No. 2772 adopted September 24, 1991 page 2 4. The proposed use is compatible with the uses in the area. Approval is effective ten days after decision of approval of the Planning Commission, unless an appeal is filed. Further, the applicant is notified as part of this application that he is required to comply with the following Conditions of Approval: SITE AND BUILDING DESIGN Approved Project This approval is for a Use Permit to allow the move-on of an existing single family home on property located at 690 San Tomas Aquino Road identified as Assessor's Parcel Number 402-02-52. Development shall be substantially as shown on the project material listed below, except as may be modified by conditions contained herein: (Planning) a. Project drawings for Louise Perez consisting of three pages, dated 8-2- 01. LANDSCAPING/FENCING Landscaping Landscaping plan indicating type and size of plant material and irrigation system shall be submitted to the Planning Department and approved by the Planning Director prior to the issuance of a building permit. Landscaping shall comply with the City's Water Efficient Landscape Standards (WELS). ( Planning) o Fencing Fencing plan indicating the location and design details of fencing to be submitted to the Planning Department and approved by the Planning director prior to the issuance of a Building Permit. (PlL~,~.ning) STREET/SITE IMPROVEMENTS o Foundation The applicant shall apply to the Building Department to obtain a building permit for a new foundation. Plans shall include structural details for all perimeter foundations and interior piers, as well as landings and sidewalk and driveway locations. Approval subject to applicable codes at the time of construction. (Building) Dedication Dedicate an additional ten feet across the street frontage for public street right of way. (Public Works) Resolution No. 2772 adopted September 24, 1991 File No. UP 91-18 - page 3 o Park Dedication Fee's Pay $10,990 in lieu of dedicating land for parks. (Public Works) o Storm Drain Fee Pay storm drain area fee at the rate of $1,875 per acre. (Public Works) o Agreement to Install Street Improvements Execute an agreement to install street improvements. (Public Works) e Encroachment Permit Prepare plans, pay fees and deposits, post surety as required to obtain the encroachment permit for all work within the public right of way. (Public Works) 10. Grading and Drainage Plan Provide three copies of the grading and drainage plan for review by the City Engineer. (Public Works) Further, the applicant is notified as part of this application that he is required to comply with the all applicable Codes and Ordinance of the City of Campbell and the State of California which pertain to this development and are not herein specified.
