PC Res 2771RESOLUTION NO. 2771 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A CONDITIONAL USE PERMIT ALLOWING A VETERINARY CLINIC AND RETAIL SALES, ON PROPERTY LOCATED AT 2110 SOUTH WINCHESTER BOULEVARD, C-2-S (GENERAL COMMERCIAL) ZONING DISTRICT; APPLICATION OF DR. MILES RODGERS, FILE NO. UP 91-17. After notification and Public Hearing as specified by law on the application of Dr. Miles Rodgers allowing a veterinary clinic and retail sales, on property located at 2110 South Winchester Boulevard, C-2-S (General Commercial) Zoning District, as per the application filed in the Planning Department on August 14, 1991~ and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. UP 91-17: 1. The sound attenuation of the veterinary clinic use should not be a significant problem to neighboring residential properties, in that: a. The main building is located 90 feet to the nearest residential structure. b. The building has insulated concrete block walls. c. The hours of operation will limit the noise from the parking lot. 2. The site contains adequate on-site parking to accommodate the proposed use. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: The establishment, maintenance, or operation of the use applied for will not be detrimental to the health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. The proposed site is adequate in size and shape to accommodate the yards, walls, fences, parking and loading facilities, landscaping and other development features required in order to integrate said use with uses in the surrounding area. The proposed site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic such use would generate; and 4. The proposed use is compatible with the uses in the area. The applicant is notified as part of this application that he is required to comply with the following Conditions of Approval: USE PERMIT 1. Approved Use: The use shall be limited to small animal medical care dogs, cats, birds, and the like and include: a. 320 square foot grooming area b. 350 square foot retail sales area (Planning) such as Noise Level: The entire clinic including treatment rooms, cages, or pens shall be maintained with a completely enclosed sound proof building constructed of materials which will ensure that no sound exceeding 65 decibels shall be audible on the exterior of the building. The clinic shall also be provided with air conditioning which is adequate to prevent the necessity of opening doors and windows for ventilation, or the applicant may supply information that adequate ventilation exists in the building without opening doors or windows. (Planning) ge Boarding: Animals shall be treated on an out patient basis and no overnight boarding shall be permitted, except that 3-5 animals may be kept overnight on the premises for treatment purposes only. (Planning) Odors: The clinic shall be designed and operated in such a manner as to guarantee that no objectional odors or noises shall be produced outside its walls, and provisions for off-site disposal of all dead animals and of all waste materials shall be made in compliance with County Health Standards. The removal of such waste materials and dead animals shall be done so as to guarantee that no obnoxious odor is produced. There shall be no burning or other disposal of dead animals on the premises. Hours of operation: Hours of operation: Monday-Friday, 7 a.m. - 6 p.m.; Saturday, 7 a.m. - 12 p.m.; Sunday, closed. Emergency calls after specific operating hours shall not be prohibited. (Planning) 6. Compliance: The clinic shall comply with other State, County, and City Ordinances or a portion thereof which pertain to the use or zoned wherein Resolution No. 2771 adopted September 24, 1991 UP 91-17- page 3 such uses located. (Planning) LANDSCAPING / IRRIGATION 7. Landscaping Plan: Applicant shall submit a landscaping plan indicating plant type and material and irrigation system to be approved by the Site and Architectural Review Committee. Prior to occupancy, the landscaping plan shall include details for the trash enclosure. The landscaping plan shall incorporate the following: 1. Enhancement of the front planters with colorful flowering plant. 2. Provide tree buffer and screening along the easterly property line in conjunction with the masonry wail adjacent to the residential areas. 3. Provide 5-6 tree wells along the eastern property line. 4. Tree variety shall include crepe myrtle (Indian varieties), evergreen pear or podocarpus, or other suitable variety approved by the landscape advisor. Tree plantings shall utilize root barriers such as bio-barrier. 5. The irrigation system in conjunction with the planting of trees shall include a perforated pipe watering detail. (Planning) HEALTH/SAFETY 8. Hazardous Materials: Prior to moving any Hazardous Materials/Gases on- site, an approved Hazardous Materials Management Plan (HMMP) must be on file. (Note: If amount of gas/chemicals are above reportable limits, full CEQA may be required.) (Fire) 9. Waste Disposal: Comply with Fire Department waste disposal requirements. (Public Works) BUILDING CODE 10. Handicapped Parking: Require relocating handicapped space to the rear parking area, and providing loading and signage. Title 24. 7102 (Building) 11. Access: Provide minimum 48" wide sidewalk at southeast side of building for access from handicapped space. Title 24. 7103 (Building) 12. Rebar: Verify existing rebar in the masonry wall elements is per plan. Notify Building Division. UBC 302(d) (Building) PROPERTY MAINTENANCE 13. Trash Enclosure: Provide concrete trash receptacle area with proper screening. Trash enclosure shall be located away from residential zoning property as far as possible, and may require elimination of one parking space. Reciprocal Access Agreement: Provide evidence of reciprocal ingress and egress to all adjacent parcels between Sanford and Rincon. 15. In_re'ess/Egress: Provide two-way driveway from Winchester Boulevard or provide evidence that parking in the access easement to Rincon Avenue has been eliminated. (Public Works) 16. Dimensions: Dimension site plan noting lines not drawn to scale. (Public Works) 17. Street Improvements: Show street improvements on site plan. (Public Works) 18. Screening: Applicant to install a 6 foot high masonry wall along the eastern property line. Details of masonry wall shall be submitted to the Planning Department and subject to approval by the Site and Architectural Review Committee. The masonry wall shall be installed within two years from the date of approval, on or before September 24, 1993. (Planning) 19. Revised Site Plan: The applicant shall submit a revised site plan evaluating the possibility of a two-way drive on Winchester Boulevard as directed by staff for review and approval by the Site and Architectural Review Committee. STREET SITE IMPROVEMENTS 20. Encroachment Permit: Obtain an encroachment permit, pay fees, and post surety for all work within the public right-of-way. (Public Works) Approval is effective ten days after decision of approval of the Planning Commission, unless an appeal is filed. Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinance of the City of Campbell and the State of California which pertain to this development and are not herein specified.
