PC Res 2770RESOLUTION NO. 2770 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A CONDITIONAL USE PERMIT ALLOWING A 550 SQUARE FOOT BUILDING ADDITION TO AN HISTORIC LANDMARK, ON PROPERTY LOCATED AT 73 SOUTH FIRST STREET, IN A PD-H (PLANNED DEVELOPMENT/HISTORIC OVERLAY) ZONING DISTRICT; APPLICATION OF MR. AND MRS. KIM MORGENTHALER, FILE NO. UP 91-16 After notification and Public Hearing as specified by law on the application of Mr. and Mrs. Kim Morgenthaler allowing 550 Square Foot addition to an Historic Landmark in a PD-H (Planned Development/Historic Overlay) Zoning District, as per the application filed in the Planning Department on August 1, 19911 and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. UP 91-16 1. The proposed addition integrates well with the existing architecture. o The design of the additions and the building materials are consistent with the existing dwelling. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: The establishment, maintenance, or operation of the use applied for will not be detrimental to the public health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. ° The proposed site is adequate in size and shape to accommodate the yards, walls, fences, parking and loading facilities, landscaping and other development features required in order to integrate said use with uses in the surrounding area. o The proposed site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic such use would generate. Resolution No. UP 91-16 adopted August 13, 1991 page two 4. The proposed use is compatible with the uses in the area. 5. The action proposed is consistent with the purposes of this chapter. o The action proposed will not be detrimental to a structure or feature of significant aesthetic, cultural, architectural or engineering interest or value of an historical nature. The Planning Commission approves File No. UP 91-16, based upon the following conditions of approval: Approved Use: The Use Permit is to allow construction on a designated Historic Landmark located at 73 South First Street, known as the Laura Campbell-Swope House built circa 1895. Approved Project: Approval of the Use Permit allows a one-story 240 square foot bathroom/utility/stairwell addition on the westerly portion of the dwelling and a 310 square foot interior attic expansion. The property is identified as Assessor's Parcel Number 412-06-039. Project drawings for the addition consist of 3 sheets prepared by Sandra A. Paim, dated July 18, 1991, by the Planning Department. Specific details of the construction include the following: Dimensions: Project drawings for the addition consist of 27 feet W X 8 feet D. Interior improvements to the attic only. Setbacks: The additions maintains a 6.2 foot sideyard setback to the northern and southern property lines, a 17 foot setback to the garage structure, and a 65 foot rear yard setback. Height: Maximum height indicated on the lower level addition is 16 feet. Building Materials: All materials on the new addition shall be consistent with the existing dwelling. Exterior design alterations: Two dormer windows on the northern and southern elevations in conjunction with the attic expansion and one dormer located on the western elevation with the single-story expansion. Resolution No. UP 91-16 adopted August 13, 1991 page three o ° Roof line: The roof will be extended in conjunction with the lower level addition. Roof pitch will remain consistent with existing roof. Building Permits: Applicant to obtain all necessary building permits prior to construction. Approval is effective after ratification by the City Council. Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinance of the City of Campbell and the State of California which pertain to this development and are not herein specified.
