BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBELL APPROVING A
CONDITIONAL USE PERMIT ALLOWING A 230 SQUARE
FOOT ROOM ADDITION TO AN HISTORIC LANDMARK,
ON PROPERTY LOCATED AT 84 NORTH THIRD STREET,
IN A PD-H (PLANNED DEVELOPMENT/HISTORIC
OVERLAY) ZONING DISTRICT; APPLICATION OF MR.
BARRY SHILMAN AND MS. SUSAN BLAKE, FILE NO. UP
91-15.
After notification and Public Hearing as specified by law on the application of
Mr. Barry Shilman and Ms. Susan Blake allowing 230 square foot room
addition to an historic landmark in a PD-H (Planned Development/Historic
Overlay) Zoning District, as per the application filed in the Planning
Department on August 1, 19911 and, after presentation by the Planning
Director, proponents and opponents, the hearing was dosed.
After due consideration of all evidence presented, the Planning Commission
did find as follows with respect to File No. UP 91-15:
1. The proposed addition integrates well with the existing architecture.
The building materials are consistent with materials used as the
existing dwelling.
3. The proposed addition is not visible from the street elevation.
Based upon the foregoing findings of fact, the Planning Commission further
finds and concludes that:
1. The action proposed is consistent with the purposes of this chapter.
The action proposed will not be detrimental to a structure or feature of
significant aesthetic, cultural, architectural or engineering interest or
value of an historical nature.

The establishment, maintenance, or operation of the use applied for
will not be detrimental to the public health, safety, peace, morals,
comfort or general welfare of persons residing or working in the
neighborhood of such proposed use, or be detrimental or injurious to
property and improvements in the neighborhood or to the general
welfare of the City.

4. The proposed site is adequate in size and shape to accommodate the
yards, walls, fences, parking and loading facilities, landscaping and
other development features required in order to integrate said use with
uses in the surrounding area.
5. The proposed site is adequately served by streets of sufficient capacity to
carry the kind and quantity of traffic such use would generate.
6. The proposed use is compatible with the uses in the area.
The Planning Commission approves File No. UP 91-15, based upon the
following conditions of approval:
1. Approved Use: The Use Permit is to allow construction on a
designated Historic Landmark located at 84 North Third Street, known
as the J.C. Ainsley house built circa 1870.
2. Approved Project: Approval of the Use Permit allows a 230 square foot
kitchen/bathroom addition on the easterly (rear) portion of the
dwelling, the property is identified as Assessor's Parcel Number 279-30-
006.
A. Project drawings for the addition consist of 3 sheets prepared by
Melvin R. Hill, P.E., dated July 30, 1991, by the Planning
Department.
Specific details of the construction include the following:
a. Dimensions: The one-story addition is 23.30 feet W x 10 feet D.
b. Setbacks: The addition maintains a 3 foot sideyard setback to the
southern property line, a 22 foot sideyard setback to the northern
property line, and a 80 foot rearyard setback.
c. Height: Maximum height indicated is 16 feet.
d. Building Materials: All materials on the new addition shall be
consistent with the existing dwelling.
3. Building Permits: Applicant to obtain all necessary building permits
prior to construction.

Approval is effective after City Council ratification of the Planning
Commission action, unless an appeal is filed.
Further, the applicant is notified as part of this application that he is required
to comply with all applicable Codes and Ordinance of the City of Campbell
and the State of California which pertain to this development and are not
herein specified.
