PC Res 2768RESOLUTION NO. 2768 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A CONDITIONAL USE PERMIT ALLOWING A GENERAL OFF-SALE LIQUOR LICENSE, ON PROPERTY LOCATED AT 1602 WEST CAMBPELL AVENUE, IN A C-1-S (NEIGHBORHOOD COMMERICAL) ZONING DISTRICT; APPLICATION OF NOB HILL FOODS, FILE NO. LIP 91-14. After notification and Public Hearing as specified by law on the application of Nob Hill Foods approving a Conditional Use Permit allowing a general off- sale liquor license in a C-1-S (Neighborhood Commercial) Zoning District, as per the application filed in the Planning Department on luly 8, 19912 and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. 91-14: The proposed used is appropriate in a C-1 (Neighborhood Commercial) Zoning District which permits business to sell alcohol upon approval of a Conditional Use Permit. o Approval of this request will not result in a over concentration of business either serving or selling alcohol. o There have been no problems related to alcohol sales with the existing Nob Hill Foods store located at 1581 West Ca~pbell Avenue. Based upon the foregoing findings of fact, the Pla~ ,~i ng Commission further finds and concludes that: The establishment, maintenance, or operation of the use applied for will not be detrimental to the public health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. 2. The proposed use is compatible with the uses in the area. The Planning Commission approves File No. UP 91-14, based upon the following conditions of approval: Resolution No. 2768 - UP 91-14 Approved August 13, 1991 Pa~e -2- 1. Hours of Operation Monday - Sunday: 6 a.m. to 10 p.m. 2. Restrictions of Use Permit Use is limited to the off-site sale of alcohol in conjunction with a full service grocery store. On-site consumption of alcohol is prohibited. Approval is effective ten days after decision of approval of the Planning Commission, unless an appeal is filed. Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinance of the City of Campbell and the State of California which pertain to this development and are not herein specified.
