BEING A RESOLUTION OF THE PLANNING
COMMISSION OF THE CITY OF CAMPBELL
RECOMMENDING DENIAL OF A GENERAL PLAN
AMENDMENT TO THE LAND USE ELEMENT OF THE
GENERAL PLAN; AND, AGAINST ADOPTING A
DENSITY TRANSFER POLICY TO A TEXT
AMENDMENT TO SECTION 21.06.010 OF THE
MUNICIPAL CODE, ESTABLISHING A DENS1TY
TRANSFER POLICY. FILE NOS. GP 91-03/TA 91-03.
After notification and public hearing as specified by law on proposed
amendments to the Land Use Element of the General Plan; and, after
presentation by the Planning Director, proponents and opponents, the
hearing was dosed.
After due consideration of all evidence presented, the Planning Commission
does find as follows, with respect to File Nos. GP 91-03/TA 91-03:
The potential benefit of creating additional open space through this
mechanism is limited and will not result in a substantial open space
acquisition for the neighborhood;
o
Such a Density Transfer mechanism would require significant
administrative cost for implementation and monitoring which could
burden the benefit to the community; and
More significant variations from the permitted residential densities
would be detrimental to the intent of the character desired for specific
zoning districts.
Based upon the foregoing findings of fact, the Planning Commission further
concludes that:
The proposed General Plan and Text Amendment would not effectively
promote the goals and policies established in the Open Space Element of
the General Plan; and
o
The additional open space acquisition possible through the Density
Transfer Police does not benefit the neighborhood on a timely basis to
warrant variations to the permitted residential densities.
The Planning Commission does hereby adopt a Resolution recommending
that the City Council deny a General Plan Amendment to the Land Use
Element of the General Plan; and, deny the proposed Text Amendment to
Resolution No. 2757
adopted June 25, 1991

Section 21.06.010 of the Municipal Code, establishing a Density Transfer
Policy.
