BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBELL APPROVING A
CONDITIONAL USE PERMIT ALLOWING THE
ESTABLISHMENT OF A TANNING/TONING SALON, ON
PROPERTY LOCATED AT 152-C NORTH SAN TOMAS
AQUINO ROAD, IN A C-2-S (GENERAL COMMERCIAL)
ZONING DISTRICT; APPLICATION OF MS.. LINDA
INGRAM, FILE NO. UP 91-03.
After notification and Public Hearing as specified by law on the application of
Ms. Linda Ingram allowing the establishment of a tanning/toning salon, on
property located at 152-C North San Tomas Aquino Road, in a C-2-S (General
Commercial) Zoning District, as per the application filed in the Planning
Department on February 27, 1991~ and, after presentation by the Planning
Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission
did find as follows with respect to File No. UP 91-03:
The proposed tanning/toning salon is an appropriate use in this
Zoning District which permits general commercial development.
2. The existing parking will be adequate to serve the development.

The proposed project is exempt from the California Environmental
Quality Act.
Based upon the foregoing findings of fact, the Planning Commission further
finds and concludes that:
The establishment, maintenance, or operation of the use applied for
will not be detrimental to the public health, safety, peace, morals, com
fort or general welfare of persons residing or working in the
neighborhood of such proposed use, or be detrimental or injurious to
property and improvements in the neighborhood or to the general
welfare of the City.
The proposed site is adequate adequate in size and shape to
accommodate the yards, walls, fences, parking and loading facilities,
landscaping and other development features required in order to
integrate said use with uses in the surrounding area.

The proposed site is adequately served by streets of sufficient capacity to
carry the kind and quantity of traffic such use would generate.
4. The proposed use is compatible with the uses in the area.
Further, the applicant is notified as part of this application that he is required
to comply with ail applicable Codes and Ordinance of the City of Campbell
and the State of Caiifornia which pertain to this development and are not
herein specified.

The applicant is hereby notified, as part of this application, that he is required
to meet the following conditions in accordance with the Ordnances of the City
of Campbell and the Laws of the State of California. Additionally, the
applicant is hereby notified that he is required to comply with all applicable
Codes or Ordinances of the City of Campbell and the State of California which
pertain to this development and are not herein specified.
Compliance with all conditions of approval shall be demonstrated prior to
issuance of building permits for the project unless otherwise noted.
Project and Site Design
1. Approved project
This approval is for the establishment of a tanning/toning salon in
1,230 sq. ft. at the San Tomas Plaza 152-C N. San Tomas Aquino Rd.
identified as Assessor's Parcel Number 307-50-064. Development shall
be substantially as shown on the drawings listed below, except as
modified by conditions contained herein:
Floor Plans for Linda Ingram, received by the Planning
Department February 27, 1991.
Use shall be as described in the Description of Project, dated
February 25, 1991, which limits business hours from 8 am to 10
pm Monday - Sunday.
Building Code Requirements
1. Requirements for the Handicapped
Comply with existing codes and handicapped law, obtain permits as
required.
