BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBELL APPROVING A CONDITIONAL
USE PERMIT, SITE AND ARCHITECTURAL APPLICATION
AND SIGN APPROVAL ALLOWING THE REMODEL OF AN
AUTO SERVICE STATION AND INSTALLATION OF A
MINI-MART, IN CONJUNCTION WITH THE OFF-SALE OF BEER
AND WINE, ON PROPERTY LOCATED AT 370 EAST HAMILTON
AVENUE, IN A C -1-S (GENERAL COMMERCIAL) ZONING DISTRICT;
APPLICATION OF COAST OIL COMPANY, FILE NOS. S 91-02/
UP 91-02 AND SA 91-04.
After notification and public hearing as specified by law on the application of
Coast Oil Company for a Conditional Use Permit; Site and Architectural
Application and a Sign Permit allowing the remodel of an auto service
station and installation of a mini-mart, in conjunction with the off-sale of
beer and wine, on property located at 370 East Hamilton Avenue, in a C-1-S
(General Commercial) Zoning District, as per the application filed in the
Planning Department on January 19, 1991; and, after presentation by the
Planning Director, proponents and opponents, the hearing was closed.
After due considerate of all evidence presented, the Planning Commission
did find as follows with respect to the Use Permit and Site and Architectural
Application:
The current General Plan land use designation for the site is
Commercial.
The current zoning designation for the site is C-1-S (Neighborhood
Commercial).
Substantial landscaping to be provided will upgrade the appearance of
the site.
Allowing less parking than required by the City's Parking Ordinance is
justified based upon the joint use of the proposed spaces.
Based upon the foregoing findings of fact, the Planning Commission further
finds and concludes that:
The proposed project, subject to the conditions imposed, will be
consistent with the General Plan and Zoning Ordinances of the City.

2. The proposed use is compatible with the uses in the area.
The proposed project, subject to the required conditions, will aid in the
harmonious development of the immediate area.
The establishment, maintenance, or operation of the use applied for
will not be detrimental to the public health, safety, peace, morals,
comfort or general welfare of persons residing or working in the
neighborhood of such proposed use, or be detrimental or injurious to
property and improvements in the neighborhood or the general
welfare of the City.
The proposed site is adequate in size and shape to accommodate the
yards, wall fences, parking and loading facilities, landscaping and other
development features required in order to integrate said use with uses
in the surrounding area.
The proposed use is adequately served by the streets of sufficient
capacity to carry the kind and quantity of traffic such use would
generate.
Based upon the above findings, the Planning Commission does hereby grant
the requested Use Permit, Sign Permit, and Site and Architectural
Application, subject to the following conditions:f
Approved Plans
This approval is remodel of an existing automobile service station and
installation of a mini-mart on a 17,900 square foot parcel identified as
Assessor's Parcel Number 279-34-029. Development shall be
substantially as shown on the project materials listed below, except as
may be modified by conditions contained herein:
a. Project drawings for Mission Trail Oil Company prepared by
Majors Engineering, Inc. consisting of eight sheets, dated
11/26/91.
b. Color board on-file in the Planning Department.

Revised Elevations
The applicant shall revise elevations plans indicating the following:
a. Limit striping of the facade to one window width past the last
window.
b. Revise exterior building materials to provide additional texture.
The revised elevations shall be submitted to the Planning Department
and approved by the Planning Director prior to application for a
building permit.

Landscape Plan
Revised landscape plan to be submitted to the Planning Department for
approval.
a. Replace Eucalyptus trees along the southwestern property line
with trees having a lower canopy to provide additional
screening between the building and the street.
b. Additional landscaping and trees shall be provided along Central
and Hamilton Avenues as redlined on the preliminary
landscape plans.
c. The landscape plan shall comply with the City's Water Efficient
Landscape Standards (WELS). A WELS checklist shall be
submitted with the final landscape plan for review and approval
of the Planning Department.

Fencing
Revised fencing plan, indicating the following, shall be submitted to
the Planning Department and approved by the Planning Director prior
to the issuance of a building permit.
a. Reduce the fence height along the 15' front and side yard
setbacks. The maximum fence height within the 15' front and
side yard setbacks shall be no greater than 3 1/2 feet.
b, Fencing materials shall be black vinyl chain link.

Garbage Disposal
Ordinance No. 782 of the Campbell Munidpal Code stipulates that any
contract for the collection and disposal of refuse, garbage, wet garbage
and rubbish produced within the limits of the City of Campbell shall be
made with Green Valley Disposal Company. This requirement applies
to all single family dwellings, multiple apartment units, to all
commercial, business, industrial, manufacturing, and construction
establishments.
Property Maintenance
The applicant is hereby notified that the property is to be maintained
free of any combustible trash, debris and weeds, until the time that
actual improvements take place.
Parking and Driveway Areas
a. Applicant shall provide 11 parking spaces.
b. All parking and driveway areas to be developed in compliance
with Chapter 21.50 of the Campbell Municipal Code. All parking

spaces to be provided with appropriate concrete curbs or bumper
guards.

Hours of Operations
Hours of operation shall be limited to the following:
Monday - Saturday 6:00 AM - 11:00 PM
Sunday 7:00 AM - 11:00 PM

The applicant shall be permitted the following signs:
a. 8 ft x 8 ft monument sign.
b. 3 ft. x 8 ft. internally illuminated sign over the story entry.
c. 2 ft. x 8 ft. internally illuminated sign for the west end of the
building.

Beer and wine sales shall be limited to off-site only.
and wine for on-site consumption is prohibited.

All hazardous material storage shall comply with Campbell Municipal
Code 17.06 and 17.09.
