PLANNING COMMISSION
BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBELL APPROVING A srrE AND
ARCHITECTURAL APPLICATION ALLOWING THE MOVE-
ON OF A SINGLE-FAMILY HOME AND CONSTRUCTION OF
A NEW HOME ON PROPERTY LOCATED AT 50 CATALPA
LANE, IN AN R-l-6 (SINGLE-FAMILY RESIDENTIAL )
ZONING DISTRICT.
After notification and Public Hearing as specified by law on the application of
Mr. Jay Shemirani for approval of plans and elevations to allow the move-on
of a single-family home and construction of a new home on property located
at 50 Catalpa Lane in an R-l-6 (Single-Family Residential) Zoning District;
and, after presentation by the Planning Director, proponents and opponents,
the hearing was closed.
After due consideration of all evidence presented, the Planning Commission
did find as follows:
Architectural Style: The proposed move-on residence and a new single-
family residence provides a traditional residential style and appearance.

Development Standards: The site plan indicates that the proposed
project meets the setback, parking, and development standards of the
city.

Massing: The proposed two-story structure on Parcel "A," by itself, is
disharmonious with the surrounding neighborhood, in that it is
unduly massive in respect to the relative size of Parcel "A."
Scale: The proposed project is in appropriate scale in relationship to
the established residential pattern in this neighborhood.
Based upon the foregoing findings of fact, the Planning Commission further
finds and concludes that:
The proposed project, subject to the conditions imposed, will be
consistent with the General Plan; and,
The proposed project, subject to the required conditions, will aide in
the harmonious development of the immediate area.
Based upon the above findings, the Planning Commission does hereby grant

the requested development, subject to the attached conditions:
Landscaping: Property to be fenced and landscaped as indicated and/or
added in red on the plans. Landscaping and fencing shall be
maintained in accordance with the approved plans.
Landscape Buffer: Landscaping plan indicating type and size of plant
material to be submitted to the Planning Department and approved by
the Planning Director prior to the application for a Building Permit.
Landscape Plan to demonstrate buffering of adjacent uses and
provision of frontyard landscaping to soften impact of building
massiveness.
Fencing: Fencing plan indicating location and design details of fencing
to be submitted to the Planning Department and approved by the
Planning Director prior to issuance of a Building Permit.

Performance Bond: Applicant to either (1) post a faithful performance
bond in the amount of $3000 to ensure landscaping, fencing; or (2) file a
written agreement to complete landscaping, and fencing. Bond or
agreement to be filed with the Planning Department prior to
application for a Building Permit.
Utility: Applicant to submit a letter to the Planning Department, prior
to installation of PG&E utility (transformer) boxes, indicating the
location of the boxes and screening (if boxes are above ground) for
approval of the Planning Director.

Parking: All parking and driveway areas to be developed in
compliance with Chapter 2.1 59 of the Campbell Municipal Code.

Noise: Noise levels for the interior of residential units shall comply
with the minimum State (Title 25) and local standards as indicated in
the Noise Element of the Campbell General Plan.
Maintenance: The applicant t is hereby notified that the property is to
be maintained free of any combustible trash, debris and weeds, until
the time that actual construction commences. All existing structures
shall be secured by having windows boarded up and doors sealed shut,
or be demolished or removed from the property. Section No. 11.201
and 11.41, 1979 Ed. Uniform Fire Code.

Building Division
9. Building Permits: Obtain Building Permits for new foundation.

Underground Utilities: Underground utilities to be provided as
required by Section 20.36.150 of the Campbell Munidpal Code.

Building Plan Check: Plans submitted to the Building Division for a
plan check shall indicate clearly the location of all connections for
underground utilities including water, sewer, electric, telephone and
television cables, etc.

Project Phasing:
Sequence: Applicant shall construct the new single-story
residence on Parcel "B," prior to, or concurrent with the move-
on and placement of the residence on Parcel "A," and, shall
submit a letter to the Planning Department in a form satisfactory
to the City Attorney, accepting this condition; or
Performance Bond: Applicant shall:
a. Construct and complete the new residence on Parcel "B"
within one year of completion of the residence on Parcel
"A,' and,
b. Enter an agreement with the City, allowing the City to
complete construction of the residence on Parcel "B" at
applicant's expense, if applicant fails to timely complete
the residence, and,
c. Post a faithful performance bond in the amount of
$160,000 to ensure performance of the foregoing
conditions.

Existing Residential Removal: Prior to issuance of Building Permits
for the house move-on, the existing residence on the property shall be
removed.
Public Works Department

Excavation Permits: Obtain excavation permits, pay fees and post
surety to replace existing driveway, repair any damage sidewalk and
any other work in the public right-of-way.

Parcel Map: Complete processing of a parcel map PM 90-11.
Traffic Control: Applicant to provide a traffic control plan for review
and approval of the Traffic Engineer for house move.
Occupancy: Building occupancy will not be allowed until public
improvements are installed.
Section 21.42.100 of the Campbell Municipal Code provides that any approval
granted under this section shall expire one year after the date upon which
such approval was granted, unless an extension or reinstatement is approved.
Approval is effective ten days after decision of approval of the Planning
Commission, unless an appeal is filed.
