APPLICATION OF MR. BOB DEIF~IBA~, ON B~tALF OF BOB~ T.k~ AND ASS0CIATE~ M 91-02 (UP 83-06) After notification and public hearing as specified by law on the application of Mr. Bob Deifenbach, on behalf of Robert Lee and Associates, for a modification to a previously approved Use Permit on property located at 570 East Hamilton Avenue, in a C-2-S (General C~,.~rcial) Zoning District, as per the application filed in the Planning Department on January 11, 1991; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Ct.auR,~ssion did find as follow~: 1. The proposed design changes are an appropriate scale for the site. 2. The project is of good design quality and will be aesthetically pleasing. e The establishment, maintenance, or operation of the use applied for will not be detrimental to the public b~alth, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. Based upon the foregoing findings of fact, tb~ Planning C~t~ission further finds a~d concludes that: ~ establishment, mintenance, or operation of the use applied for will not be detrimental to the public health, safety, peace, morals, comfort or general welfare of persons residing or working in th~ neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. e The proposed site is adequate in size and shape to acc~0date the yards, wall, fences, parking and loading facilities, landscaping and other development features required in order to ~te said use with uses in the ~ area. Resolution No. 2733 FehD~a~ 12, 1991 page two Based on the above findings, the Planning Cuu~ission does hereby grant the requested Use Permit, subject to the followir~ conditions: 1. Repair any existing damaged slumpstone structures on site. 2. Remove sig~age fr~n windows of food mart. 3. Obtain all necessary building permits prior to c~,,,encing construction. e Signage approved as redlined. Amend plans reflecting modified signage program on building plans pri~r to issuanoe of a building ~_~mit. Approved sign program consists of the following: 1. Canopy sign (Shell sign and logo). 2. Foot Mart Sign. 3. Retention of existing 3 sided free standing price signs and 2 ~ mot~lted price signs. ~ne applicant is notified as part of this application that he/she is required to comply with all applicable Codes and/or (ImPOrtances of the City of Campbell and the State of California which pertain to this develo~ and are not herein specified.
