PC Res 2724RESOLUTION NO. 2724 PLANNING COMMISSION BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A CONDITIONAL USE PERMIT ALLOWING THE ESTABLISHMENT OF AN AUTO REPAIR USE IN AN EXISTING COMMERCIAL BUILDING LOCATED ON PROERPTY KNOWN AS 1820 SOUTH WINCHESTER BOULEVARD, IN A C-2-S (GENERAL COMMERCIAL) ZONING DISTRICT· (APPLICATION OF MR. BRIAN JACOBSON, ON BEHALF OF GRIFFIN & BANKS ARCHITECTS, UP 90-15)· After notification and public hearing as specified by law on the application of Mr. Brian Jacobson for a Conditional Use Permit allowing the establishment of an auto repair use in an existing commercial building on property located at 1820 South Winchester Boulevard, in a C-2-S (General Commercial) Zoning District, as per the application filed in the Planning Department on December 13, 1990; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission finds as follows with regard to the Application No. UP 90-15 for a Conditional Use Permit for the City of Campbell: Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: The Campbell Municipal Code, section 21.40.030, allows auto repair facilities in C-2 zones upon approval of a conditional Use Permit. 2. The site of the proposed use is designated for commercial uses. Minor alterations of existing facilities involving negligible or no expansion of use beyond that previously existing are exempt from the California Environmental Quality Act. Based on the above findings, the Planning Commission does hereby grant the requested Use Permit, subject to the following conditions: The establishment, maintenance, or operation of the use applied for will not be detrimental to the public health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. The proposal meets the requirements of the Campbell Municipal Code, Section 21.24.030, for approval of a Conditional Use Permit. The proposed use is consistent with the General Plan and zoning for the City of Campbell. Substantial landscaping to be provided will upgrade the appearance of the site. The applicant is notified as part of this application that he/she is required to comply with all applicable Codes and/or Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified.
