PC Res 2723RESOLUTION NO. 2723 PLANNING COMMISSION BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A SITE AND ARCHITECTURAL REVIEW PERMIT FOR A 7500 SQUARE FOOT AUTOMOBILE REPAIR BUILDING LOCATED AT 980 CAMDEN AVENUE, IN A M-1-S (LIGHT INDUSTRIAL) ZONING DISTRICT. APPLICATION OF JIM D. MORELAN, AIA. APPLICATION NO. S 90-10 After notification and public hearing as specified by law on the proposed Site and Architectural Review Permit S 90-10; and after presentation by the Planning Director and proponents and opponents, the hearing was dosed. After due consideration of all evidence presented, the Planning Commission of the City of Campbell, California does find as follows: The current General Plan land use designation for the site is Light Industrial 2. The current Zoning designation for the site is M-1-S (Light Industrial). o The M-1-S zoning district requires approval of a Site and Architectural Review Permit for construction of new buildings. An Initial Study has been prepared for the project as required by the California Environmental Quality Act. The project will provide an easement for public access to the Los Gatos Creek Trail. The project will provide a parking easement over a portion of the parking lot for public parking when the business is not in operation. Based upon the foregoing findings of fact, the Planning Commission concludes that: 1. The proposed project, subject to the conditions imposed, will be consistent with the General Plan. The proposed project, subject to the conditions imposed, will aid in the harmonious development of the immediate areas. 3. The proposed project is consistent with the M-I, Parking, and Landscaping and Open Space Ordinances of the City. Planning Commission Resolut~ . No. 2723 Parle -2- January 22,1991 A Negative Declaration has been prepared for the project as no substantial evidence has been presented which demonstrates that the project would have a significant adverse impact on the environment. The Planning Commission does hereby adopt a Resolution approving Application No. $ 90-10, subject to the following conditions of approval. Compliance with all conditions of approval shall be demonstrated prior to issuance of building permits for the project unless otherwise noted. 1. Approved Project This approval is for a 7,500 square foot automotive repair building located on a 22,795 square foot site identified as Assessor's Parcel Number 412-01-002. Development shall be substantially as shown on the project materials listed below, except as may be modified by conditions contained herein: at Project drawings for A&E Performance prepared by Morelan Associates, Inc. consisting of seven sheets, dated 10/31/90. Color board on-file in the Planning Department Perspective Drawing 2. Landscape Plan The landscape plan shall comply with the City's Water Efficient Landscape Standards (WELS). A WELS checklist shall be submitted with the final landscape plan for review. The applicant shall investigate the feasibility of relocating the power pole at the southeast corner of the structure in order to eliminate the landscape planter at said corner at increase the depth of the planter along the eastern property line. The landscape plan shall be revised to provide for black-clad chain link fence. The final landscape plan shall be submitted to the Site and Architectural Review Committee for review and approval. 3. Existing Trees The following trees shall be preserved: - 15" diameter oak - 24" diameter sycamore - 18" diameter sycamore Planning Commission Resolut~ No. 2723 Pa~e -3- January 22,1991 The applicant shall submit a tree preservation report prepared by a landscape architect or arborist evaluating the effect of the project on the health of the trees and specifying methods to be used to help ensure the long-term survival of the trees. The applicant shall implement the recommendations of the report. The report shall be approved by the Planning Department prior to issuance of a building permit. 4. Parking Easement The applicant shall record a covenant running with the land over the northerly 12 parking spaces and driveway to allow public parking for users of the Los Gatos Creek Trail on weekends and on weekdays from 6:30 p.m. to 7:30 a.m. The covenant shall be submitted for review and approval of the City Attorney and the Planning Department. No cars assodated with the business shall be parked in the northerly 12 spaces during the hours cited above. 5. Parkin~ Si_~n The applicant shall install a sign at the entry to the parking lot listing the hours during which users of the Los Gatos Creek Trail may use the parking lot. 6. Landscaping on Santa Clara Valley Water District Lands The applicant shall provide shrubs on on Santa Clara Valley Water District (SCVWD) lands adjacent to the chain link fence on the easterly property line. The intent of the condition is to provide vegetative screening of the fence when viewed from the Los Gatos Creek Trail. The landscaping shall be shown on the final landscape plan and is subject to approval of the Planning Department. Staff may waive this condition if the applicant cannot obtain permission of the SCVWD for such landscaping. Public Works 1. Access Easement Dedicate a 20 foot wide access easement over the driveway area to the Santa Clara Valley Water District. 2. Path Easement Dedicate a 10 foot wide public path easement to the City of Campbell along the northerly boundary of the site. Planning Commission Resolu~ Pa~e -4- No. 2723 January 22,1991 3. Excavation Permit Obtain an excavation permit, pay fees, and post surety to install cul-de- sac and public path. 4. Land Exchange Provide documentation of a complete land exchange between the City of Campbell and the Santa Clara Valley Water District (SCVWD) and documentation of vacation of Camden Avenue and the former portion of Casey Road. 5. Storm Drain Fee Pay storm drain fee of $1,110.00. 6. Legal Description Provide a legal description for a certificate of compliance. 7. SCVWD Access Provide uninterrupted access to the SCVWD facility during construction. 8. Flood Control Easement Provide an 8 foot wide flood control easement for SCVWD at the top of the concrete bank. 9. Gate Radius Provide a 20 foot radius from the gate along the site's easterly property line to the bicycle path and revise the valley gutter. Buildin_~ Dcp~rtment 1. Padfic Gas & Electric Submit the Boundary and Topographical Map to Padfic Gas & Electric (PG&E) Land Use Department. Provide a letter from PG&E authorizing construction within the distances shown on the plan. Planning Commission Resolu~ . No. 2723 Pa~;e -5- January 22, 1991 Fire Department 1. Fire Sprinklers Provide supervised fire sprinkler protection throughout the building. 2. Fire Hydrant Provide one on-site or municipal fire hydrant located as directed by the Fire Department. 3. Access Driveway vertical clearance shall be maintained at not less than 13 feet, 6 inches above grade.
