PLANNING COMMISSION
BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBELL APPR0VING A SITE AND
ARCHITECTURAL APPLICATION ALLOWING THE
MOVE-ON OF AN EXISTING RESIDENCE ONTO PROPERTY
LOCATED AT 1566 WALTERS AVENUE IN A R-l-9 (SINGLE-
FAMILY RESIDENTIAL) ZONING DISTRICT. APPLICATION OF
MR. MICHAEL T. BROCKWAY, S 90-08.
After notification and public hearing as specified by law on the
application of Mr. Michael T. Brockway for approval of plans to allow
the move-on of an existing residence on property located at 1566 Walters
Avenue in a R-l-9 (Single-Family Residential) Zoning District; and,
after presentation by the Planning Director, proponents and opponents,
the hearing was closed.
After due consideration of all evidence presented, the Planning
Commission did find as follows:
The General Plan allows a density range of less than 4.5 dwellings
units per acre on the subject site.
The proposal will result in a density of 2.9 dwelling units per
acre.
3. The parking provided exceeds the code requirements.
The project is single story which minimizes impacts on the
neighboring properties.
Based upon the foregoing findings of fact, the Planning Commission
further finds and concludes that:
The proposed project, subject to the conditions imposed, will be
consistent with the general plan,
The proposed project, subject to the required conditions, will aid
in the harmonious development of the immediate area.
The proposed project is an appropriate scale in.relationship to the
adjacent developed uses.
Based on the above findings, the Planning Commission does hereby grant
the requested development, subject to the attached conditions.
Section 21.42.100 of the Campbell Municipal Code provides that any
approval granted under this Section shall expire one year after the date
upon which such approval was granted, unless an extension or
reinstatement is approved.

This approval is effective ten days after decision of approval of the
Planning Commission, unless an appeal is filed.

The applicant is hereby notified, as part of this application, that he is required
to meet the following conditions in accordance with the Ordinances of the
City of Campbell and the Laws of the State of California. Additionally, the
applicant is hereby notified that he is required to comply with all applicable
Codes and Ordinances of the City of Campbell and the State of California,
which pertain to this development and are not herein specified.
Site and Architectural approval is granted for site plan and elevations,
dated 9/25/90.

Applicant shall revise site plans indicating relocation of the residence 5'
east from location shown on site plans dated 9/25/90. Revised plans are
to be submitted to the Planning Director for approval, prior to issuance
of building permits.

Applicant shall prepare a plan to protect the existing 2'-9" diameter
redwood tree during the construction process. Plan to be approved by
the Planning Director, prior to the issuance of building permits.

All parking and driveway areas to be developed in compliance with
Chapter 21.50 of the Campbell Munidpal Code.

Plans submitted to the Building Department for plan check shall indicate
clearly the location of all connections for underground utilities
including water, sewer, electric, telephone and television cables, etc.
Ordinance No. 782 of the Campbell Municipal Code stipulates that any
contract for the collection and disposal of refuse, garbage, wet garbage and
rubbish produced within the limits of the City of Campbell shall be made
with Green Valley Disposal Company. This requirement applies to all
single family dwellings, multiple apartment units, to ali commercial,
business, industrial, manufacturing, and construction establishments.

The applicant is hereby notified that the property is to be maintained free
of any combustible trash, debris and weeds, until the time that actual
relocation commences.

BUILDING DEPARTMENT
Section 104(e) Uniform Building Code states "Buildings or structures
moved into or within the jurisdiction shall comply with the provisions
of this code for new buildings or structures".
PUBLIC WORKS DEPARTMENT
9. Dedicate land to widen Walters Avenue to 30 feet from center line.
10. Pay storm drain area fee of $726.00.
11. Pay a fee of $4,598.00 in lieu of dedication land for parks.
12. Execute an agreement and post surety for future street improvements.
13. Provide 5 sets of on-site grading and drainage plans.
