PLANNING COMMISSION
BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBELL APPROVING A MODIFICATION TO A
PREVIOUSLY APPROVED USE PERMIT ALLOWING A FOUR-YEAR
EXTENSION OF A YOUTH CENTER ON PROPERTY LOCATED AT
1739-1757 SOUTH WINCHESTER BOULEVARD (APPLICATION OF MR.
TIM BAKER, M 90-18).
After notification and public hearing as specified by law on the
application of Mr. Tim Baker for Modification of a previously approved
Use Permit to allow a four-year extension of the youth center on
property located at 1739-1757 South Winchester Boulevard in a C-2-S
(Generl Commercial) Zoning District, as per the application filed in the
Planning Department on October 3, 1990; and, after presentation by the
Planning Director, proponents and opponents, the hearing was closed.
After due consideration of all the evidence presented, the Planning
Commission did find as follows:
Limiting the use for a period of four years provides the
opportunity to review the continued compatibility of the youth
facility in relation to other uses in the shopping center.
2. There are no immediate plans to redevelop the shopping center.
The youth center is able to share use of parking facilities with
the retail uses in the shopping center.
The youth center has not had an adverse traffic impact, and is
adequately served by existing streets.
Based upon the foregoing findings of fact, the Planning Commission
further finds and concludes that:
The establishment, maintenance, and continued operation of the
youth facility for a four-year period will not be detrimental to
the public health, safety, peace, morals, comfort or general
welfare of person residing or working in the neighborhood of such
proposed use, or be detrimental or injurious to property and
improvements in the neighborhood or to the general welfare of the
City.
The shopping center site is adequate in size and shape to
accommodate the yards, wall, fences, parking and loading
facilities, landscaping and other development features required in
order to integrate said use with retail uses in the shopping
center.
The shopping center site is adequately served by streets of
sufficient capacity to carry the kind and quantity of traffic such
use would generate, which is equal to or less intense than the
adjacent retail uses.

The temporary youth center use is compatible with other uses in
the area.
Based on the above findings, the Planning Commission does hereby grant
the requested Use Permit, subject to the following condition:
The use is for a period of four years from the date of approval by
the Planning Commission, or if appealed, four years from the date
of approval by the Planning Commission.
The applicant is notified as part of this application that he/she is
required to comply with all applicable Codes and/or Ordinances of the
City of Campbell and the State of California which pertain to this
development and are not herein specified.
