PC Res 2704RESOLUTION NO. 2704 PLANNING COMMISSION BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL RECOMMENDING APPROVAL OF A PLANNED DEVELOPMENT PERMIT, PLANS, ELEVATIONS, DEVELOPMENT SCHEDULE, AND CONDITIONS OF APPROVAL TO ALLOW CONSTRUCTION OF 5 SINGLE-FAMILY HOMES, ON PROPERTY LOCATED AT 1265 AND 1271 BURROWS ROAD , IN A PD (PLANNED DEVELOPMENT) ZONING DISTRICT. APPLICATION OF MR. KURT ANDERSON, FILE NO. PD 90-02. After notification and Public Hearing as specified by law on the application of Mr. Kurt Anderson, for approval of a Planned Development Permit, plans, elevations, and development schedule to allow the construction of 5 single-family homes, on property located at 1265 and 1271 Burrows Road, in a PD (Planned Development) Zoning District; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows: The proposed Zone Change and Planned Development Permit are consistent with the Land use Element of the General Plan. The project massing and design is consistent with other developments in the surrounding area and promotes a low-density, rural character, as required by the development policies for the San Tomas Area. The proposed density is no greater than would be allowed in a conventional R-i-$ (Single-Family) Zoning District. The subdivision is designed to minimize traffic and access impacts upon the adjoining street system. The subject property is located on the corner of arterial and collector streets and across from an existing shopping center. Based upon the foregoing findings of fact the Planning Commission further finds and concludes as follows: The proposed development and uses result in a more desirable environment and use of the land than would be possible under any other zoning classification. The development and uses are compatible with the General Plan of the City and will aid in the harmonious development of the immediate area. The proposed zoning is consistent with the Land Use Element of the General Plan. The proposed zoning is compatible with the surrounding zoning and land uses. Page Two Resolution No. 2704 PD 90-08 - 1265 and 1271 Burrows Road The proposed zoning will not be detrimental to the health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. Based upon the above findings, the Planning Contmission recommends approval of the plans, elevations, development schedule, and conditions of approval as presented; and, further recommends that the City Council approve a Planned Development Permit and enact the attached Resolution adopting said plans, elevations, development schedule, and conditions of approval for that portion of the above-referenced Planned Development Zoning District. DATE: OCTOBER 23, 1990 The applicant is hereby notified, as part of this application, that he/she is required to meet the following conditions in accordance with the Ordinances of the City of Campbell and the Laws of the State o~ ~al~£ornla. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California, which pertain to this development and are not herein specified. Revised site plan indicating revised circulation for Lot No. 1, to be submitted to the Planning Department and approved by the Planning Director upon recommendation of th·Architectural Advisor prior to application for a Building Permit. Property to be fenced and landscaped as indicated and/or added in red on the plans. Landscaping and fencing shall be maintained in accordance with the approved plans. All parking spaces to be provided with appropriate concrete curbs or bumper guards. 10. Underground utilities to be provided as required by Section 20.36.150 of the Campbell Municipal Code. 11. Plans submitted to the Building Department for plan check shall indicate clearly the location of all connections for underground utilities including water, sewer, electric, telephone and television cables, etc. 12. Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single-family dwellings, multiple apartment units, to all commercial, business, industrial, manufacturing, and construction establishments. 13. Noise levels for the interior of residential units shall comply with minimum State (Title 25) and local standards as indicated in the Noise Element of the Campbell General Plan. 14. Applicant is hereby notified that he will be required to pay Park Dedication In-Lieu Fee which will be assessed at the time the subdivision map is submitted. 15. The applicant is hereby notified that the property is to be maintained free of any combustible trash, debris and weeds, until the time that actual construction commences. All existing structures shall be secured by having windows boarded up and doors sealed shut, or be demolished or removed from the property. Section 11.201 & 11.414, 1979 Ed. Uniform Fire Code. BUILDING DEPARTHENW 16. Retaining walls at property lines are limited to a height of 15 inches if constructed of wood. 17. Grading Permits are also required for the project. Dedicate additional land to widen Hacienda Avenue to 90 feet. 20. Install standard street improvement in Hacienda Avenue and Burrows Road across the entire frontage. 21. Obtain an encroachment permit, pay fees and post surely for all work in the public right at way. 22. Pay storm drain area fee. 23. Submit five copies of the grading and drainage plan for the City Engineers review showing the relationship to adjacent properties. 24. Reconfirm layout to remove situation of cars backing out onto Hacienda. 25. Provide pork chop island or other traffic control measure approved by City Engineer to safely channelize eastbound Hacienda through the intersection. FIRE DEP~ 26. Install one (1) public fire hydrant at the driveway entrance to Lot No. 5, and Burrows Road providing a minimum required fire flow of 1,000 GPM.
