PC Res 2699RESOLUTION NO. 2699 PLANNING COMMISSION BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL RECOMMENDING APPROVAL OF A PLANNED DEVELOPMENT PERMIT, PLANS, ELEVATIONS, DEVELOPMENT SCHEDULE, AND CONDITIONS OF APPROVAL TO ALLOW THE CONSTRUCTION OF A SECOND SINGLE-FAMILY DWELLING UNIT AND AN ADDITION TO AN EXISTING SINGLE-FAMILY DWELLING UNIT ON PROPERTY LOCATED AT 176 EAST RINCON AVENUE, IN A PD (PLANNED DEVELOPMENT) ZONING DISTRICT. APPLICATION OF MR. JOE PUCCI, PD 90-05. After notification and Public Hearing as specified by law on the application of Mr. Joe Pucci, for approval of a Planned Development Permit, plans, elevations, and development schedule to allow the Construction of a second single-family dwelling unit and an addition to an existing single-family dwelling unit, on property located at 176 East Rincon Avenue, in a PD (Planned Development) Zoning District; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows: The General Plan allows a density range of 6-13 dwelling units per acre on the subject site; The proposal will result in a density of 9.5 dwelling units per gross acre; The proposed parking meets the requirements of the Parking Ordinance; ® Retention of the existing unit preserves the historic appearance of the Rincon Avenue streetscape. The proposed development would clearly result in a more desirable environment and use of land than would be possible under any other zoning classifications. The proposed development would be compatible with the General Plan of the City, and will aid in the harmonious development of the immediate area; The proposed development will result in allowing more residential units than would be allowed by other residenti&l zoning districts which are consistent with the General Plan designation of the property; The propose~ development would not be detrimental to the health, safety, or welfare of the neighborhood or of the City as a whole; Resolution No. 2699 176 East Rincon Avenue PD 90-05 - Page two The proposed additional livingunits is compatible with the surrounding neighborhood; and, 10. The project is consistent with the Development Policies for downtown residential neighborhoods contained in Ordinance No. 1797. Based upon the above findings, the Planning Commission recommends approval of the plans, elevations, development schedule, and conditions of approval as presented; and, further recommends that the City Council approve a Planned Development Permit and enact the attached Ordinance adopting said plans, elevations, development schedule, and conditions of approval for that portion of the above-referenced Planned Development Zoning District. Based upon the above findings, the City Council approves the Permit by adopting the attached Exhibit A, entitled Plans and Elevations; Exhibit B, entitled Development Schedule; Exhibit C, entitled Map of Said Property; and Exhibit D, entitled Conditions of Approval, as per the application of Joe Pucci for plans, elevations, and development schedule to allow the construction of a second dwelling unit and an addition to an existing dwelling unit, in a Planned Development Zoning District. Copies of Said Exhibits are on file in the Planning Department. Construction to be completed within one year of starting date. EXHIBIT D - Conditions of Approval CONDITIONS OF APPROVA~ FOR FILE NO. PD 90-05 SITE ADDRESS: 176 EAST RINCON AVENUE AP?LICANT: J. MTG= 9-11-90 The applicant is hereby notified, as part of this application, that he/she is required to meet the following conditions in accordance with the Ordinances of the City of Campbell and the Laws of the State of California. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California, which pertain to this development and are not herein specified. Approval for plans stamped received August 9, 1990, for the addition to an existing residence and construction of a second single-family residence. Applicant shall revise the gable roofing at the front entry way to the new unit. Revised plans are to be submitted to the Planning Department and approved by the Planning Director. Prior to the issuance of a Building Permit, the applicant shall provide the Planning Department with an arboristts report detailing the condition of the existing 5 foot diameter Pepper tree and providing a suitable plan for protecting the tree during the construction phase of the project. The plan shall evaluate the need to "hand dig"the foundation adjacent to the tree and bridge the foundation over major tree roots· If the arborist~s report indicates the tree is in poor condition and/or is not likely to survive, the Planning Director shall have the authority to approve its removal. The applicant shall record a covenant running with the land which obligates the property owner to participate in the engineering design costs and install improvements to the alley located to the rear of the subject property, at a date to be determined by the City. A draft of the covenant shall be submitted for review and approval of the Planning Department and City Attorney prior to recordation. The covenant shall be recorded prior to issuance of Building Permits. Landscaping plan indicating type and size of plant material, and location of irrigation system to be submitted to the Planning Department and approved by the Plannina Director prior to application for a building permit. All parking and driveway areas to be developed in compliance with Chapter 21.50 of the Campbell Municipal Co~e. Plans submitted to the Building Division for plan check shall indicate clearly the location of all connections for underground utilities including water, sewer, electric, telephone and television cables, etc. CONDITIONS OF APPROVAL FOR FILE NO. MTG: 9-11-90 page 2 Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single-family dwellings, multiple apartment units, to all commercial, business, industrial, manufacturing, and construction establishments. 0 The applicant is hereby notified that the property is to be maintained free of any combustible trash, debris and weeds, until the time that actual construction commences. BUILDING DIVISION 10. Plans must meet minimum code requirements at the time of technical review. PUBLIC WORKS DEPARTMENT 11. Dedicate an additional 5 feet for street right-of-way to provide 30 feet from the centerline. ~ 12. Pay a fee in lieu of dedicating land for parks in the amount of $4,548 for the additional unit. 13. Pay pro-rata share of new traffic signal at Rincon Avenue and Winchester Boulevard in the amount of $875. 14. Pay storm drain area fee of $305.
