PC Res 2689RESOLUTION NO. 2689 PLANNING COMMISSION BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A USE PERMIT ALLOWING THE CONSTRUCTION OF A SECONDARY LIVING UNIT ON PROPERTY LOCATED AT 1210 WEST LATIMER AVENUE (APPLICATION OF MR. AND MRS. VICTOR SPRAJC, UP 90-10). After notification and public hearing as specified by law on the application of Mr. and Mrs. Victor Sprajc for a Conditional Use Permit approving construction of a secondary living unit on property located at 1210 West Latimer Avenue, in an R-l-6 (Single-Family/Low Density Residential) Zoning District, as per the application filed in the Planning Department on June 29, 1990; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows: The proposed additional living unit is consistent with the land use element of the General Plan. The proposed additional living unit is consistent with the requirements of the Zoning Ordinance. The proposed additional living unit will not be harmful or detrimental to the surrounding neighborhood. Bayed on the above findings, the Planning Commission does hereby grant the requested Use Permit, subject to the following conditions: Prior to issuance of a Building Permit, applicant to provide the City Attorney with evidence that a Deed Restriction has been recorded for the property setting forth the occupancy requirement that no more than one dwelling unit on the parcel shall be rented or leased. Prior to issuance of a Building Permit, the applicant shall provide the Planning Department with an arborist report detailing the condition of the existing 24 inch walnut tree and providing a suitable plan for protecting the tree during the construction phase of the project. The plan shall evaluate the need to "hand dig" the foundation adjacent to the tree and bridge the foundation over major tree roots. 3. Only one electric meter will be approved for both structures. Plans must meet minimum code requirements at the time of technical review. Se Dedicate additional land to widen Latimer Avenue to 30 feet from centerline. Resolution No. 2689 page two e Obtain an excavation permit, pay fees, and post surety to install sidewalks, driveway, and any other required work in the right-of-way. 7. Pay storm drain area fee. The applicant is notified as part of this application that he/she is required to comply with all applicable Codes and/or Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified.
