PC Res 2685RESOLUTION NO. 2685 PLANNING COMMISSION BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A USE PERMIT ALLOWING THE OPERATION OF A PRIVATE CLUB, INCLUDING SALE OF ALCOHOLIC BEVERAGES TO CLUB MEMBERS ON PROPERTY LOCATED AT 559 WESTCHESTER DRIVE (APPLICATION OF MR. JAMES ABBOTT, ON BEHALF OF THE LOS GATOS MOOSE LODGE, UP 90-09). After notification and public hearing as specified by law on the application of Mr. James Abbott for a Use Permit and approval of the operation of a private club, including sale of alcoholic beverages to club members on property located at 559 Westchester Drive in an M-i-S (Light Industrial) Zoning District, as per the application filed in the Planning Department on June 20, 1990,; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows: Strict or literal interpretation and enforcement of the specified regulation would result in practical difficulty or unnecessary physical hardship inconsistent with the objectives of the Zoning Ordinance. There are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property which do not apply generally to other properties classified in the same zoning district. Strict or literal interpretations and enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties classified in the same zoning district. The granting of the variance will not constitute a grant of special privilege inconsistent with the limitations on other properties classified in the same zoning district. The granting of the variance will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. Based on the above findings, the Planning Commission does hereby grant the requested Use Permit, subject to the following condtions: Use Permit to be reviewed by the Planning Commission after the Lodge has been in operation at this location for six months to determine adequacy of the parking and compatibility with the neighboring uses. Hours of operation shall be limited as follows: Monday - Thursday 8:00 a.m. to 11:00 p.m. Friday - Saturday 8:00 a.m. to 2:00 a.m. Sunday 8:00 a.m. to 11:00 p.m. During "normal business hours" (i.e. 8:00 a.m. to 5:00 p.m.), use of the property is to be limited so as not to require any off-site parking. Applicant to obtain all necessary permits from the Building Department. Additional exits will be required per U.B.C. section 3303(C) and Table 33A. All exit doors are to swing in the direction of exit travel. All exit doors are to be provided with panic hardware. All exits are to be marked with lighted exit signs. Provide emergency illumination for building interior. All decorative material/wall hangings are to be flame/fire retardant treated. Provide one (1) additional exit from Main Hall. Maintain 1 hour wall between existing machine shop and proposed Main Hall. Provide detail of kitchen cooking equipment & extinguishing system. Post occupant load sign in assembly area. Applicant to secure any required permits from the Santa Clara County Health Department for kitchen facilities. The applicant is notified as part of this application that he/she is required to comply with all applicable Codes and/or Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified.
