PC Res 2684RESOLUTION NO. 2684 PLANNING COMMISSION BEING AN ORDINANCE OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A VARIANCE ALLOWING A VARIANCE TO THE MAXIMUM HEIGHT FOR PROPOSED GARAGE ON PROPERTY LOCATED AT 910 HAZEL AVENUE, IN AN R-l-6 (SINGLE-FAMILY/LOW DENSITY RESIDENTIAL) ZONING DISTRICT. APPLICATION OF MR. THOMAS FERGUSON. V 90-05 After notification and public hearing as specified by law on the application of Mr. Thomas Ferguson for a variance to the maximum height for proposed garage on property located at 910 Hazel Avenue in an R-l-6 (Single-Family/Low Density Residential) Zoning District, as per the application filed in the Planning Department on June 14, 1990; and, after presentation by the Planning Director, the hearing was closed. After due consideration of all evidence presented, the Commission did find as follows: Strict or literal interpretation and enforcement of the specified regulation would result in practical difficulty or unnecessary physical hardship inconsistent with the objectives of the Zoning Ordinance. There are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property which do not apply generally to other properties classified in the same zoning district including: 1. The extraordinary setback of the existing dwelling. 2. Numerous trees located on the property. 3. Unusual roof slope on the existing dwelling. Strict or literal interpretations and enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties classified in the same zoning district. The granting of the variance will not constitute a grant of special privilege inconsistent with the limitations on other properties classified in the same zoning district. Se The granting of the variance will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. Resolution No. 2684 page 2 Based on the above findings, the Planning Commission does hereby recommend approval of the requested variance, subject to the following condition. Revised plans to reflect the window element lowered on the Hazel Avenue elevation as specified by the Architectural Advisor.
