PC Res 2673RESOLUTION NO. 2673 PLANNING COMMISSION BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A MODIFICATION TO A PREVIOUSLY APPROVED SITE AND ARCHITECTURAL APPLICATION ALLOWING THE DEVELOPMENT OF A MINI-MART ON PROPERTY KNOWN AS 3405 SOUTH WINCHESTER BLVD., (APN 406-30-004) IN A C-2-S (GENERAL COMMERCIAL) ZONING DISTRICT. APPLICATION OF BRUCE GREENFIELD ON BEHALF OF ROBERT LEE & ASSOCIATES. FILE # M90-07. After notification and public hearing as specified by law on the application of Mr. Bruce Greenfield for approval of plans and elevations to allow the construction of a mini-market on property known as 3405 South Winchester Blvd. in a C-2-S (General Commercial) Zoning District; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows: Parking: The parking provided meets/exceeds the code requirements. Compatibility:. The proposed remodel will not impact adjacent uses or existing parking facilities. Use: The proposed interior remodel is a minor expansion of the previously approved Site and Architectural approval. Based on the above findings, the Planning Commission does hereby grant the requested development, subject to the attached conditions: Revised site plan indicating additional landscape area to be submitted to the Planning Department and approved by the Planning Director upon recommendation of the Site and Architectural Review Committee prior to application for a building permit. No liquor sales from the premises are permitted. Use Permit for liquor sales must be obtained prior to application to the Alcohol Beverage Control. 3. Hours of operation limited to 6:00 a.m., to 12:00 midnight. Buildinq Department Handicap regulations must be complied with for access (i.e., walking paths, sidewalks and restrooms following ). PAGE 2 Section 21.42.100 of the Campbell Municipal Code provides that any approval granted under this Section shall expire one year after the date upon which such approval was granted, unless an extension or reinstatement is approved. Approval is effective ten days after decision of approval of the Planning Commission, unless an appeal is filed.
