PC Res 2670RESOLUTION NO. 2670 PLANNING COMMISSION BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A CONDITIONAL USE PERMIT ALLOWING THE ESTABLISHMENT OF AN OFFICE USE OF APPROXIMATELY 1050 SQUARE FEET ON PROPERTY KNOWN AS 220 EAST CAMPBELL AVENUE (APPLICATION OF SANTA CLARA VALLEY ASSOCIATION RED CARPET REALTY),IN A C-3-S (CENTRAL BUSINESS DISTRICT/COMMERCIAL) ZONING DISTRICT. FILE # 90-06. After notification and public hearing as specified by law on the application of Santa Clara Valley Association, Inc. (Red Carpet Realty) for a Conditional Use Permit to allow the establishment of an office use of approximately 1050 square feet on property known as 220 East Campbell Avenue, in a C-3-S (Central Business District/Commercial) Zoning District,) as per the application filed in the Planning Department; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Commission did find as follows: Health/Safety: The establishment, maintenance or operation of the use applied for will not be detrimental to the health, safety, peace, morals, comfort or general welfare of person residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. Compatibility: The proposed site is adequate in size and shape to accommodate the yards, walls, fences, parking and loading facilities, landscaping and other development features required in order to integrate said use with uses in the surrounding area. Traffic: The proposed site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic such use would generate. e Compatibility: area. The proposed use is compatible with the uses in the Compatibility: The use is essential or desirable to the public convenience or welfare, and is in harmony with the various elements of objectives of the City's General Plan. Zoning: The proposed use will incorporate the objective of the C-3-S Zoning District by contributing to the mixed use in the area. UP 90-06 - Resolution 2670 Page 2 Based on the above findings, the Planning Commission does hereby grant the requested Use Permit, subject to the following conditions: Redevelopment Complete a review of the office use in two years to determine appropriateness of said use in the Downtown area. The applicant is notified as part of this application that he is required to comply with all applicable Codes and/or Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified. USE PERMIT SHALL NOT BECOME EFFECTIVE UNTIL RATIFIED BY THE CITY COUNCIL. PASSED AND ADOPTED this 10th day of April, 1990 by the following roll call vote: AYES: NOES: ABSENT: Commissioners: Meyer.
