PC Res 2669RESOLUTION NO. 2669 PLANNING COMMISSION BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A SITE AND ARCHITECTURAL APPLICATION ALLOWING THE DEVELOPMENT OF A SINGLE-FAMILY HOME ON PROPERTY KNOWN AS 863 ROBIN LANE, APN 404-29-10 IN A R-l-16 (SINGLE FAMILY RESIDENTIAL/LOW DENSITY RESIDENTIAL LESS THAN 3.5 UNITS PER GROSS ACRE) ZONING DISTRICT. APPLICATION OF MR. JERRY HOUSTON, S 90-04). After notification and public hearing as specified by law on the application of Mr. Jerry Houston for approval of plans and elevations to allow the construction of a single-family home on property known as 863 Robin Lane, APN 404-29-10 in a R-l-16 (single family residential/low density residential less than 3.5 units per gross acre) Zoning District; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows: Scale: The proposed project is an appropriate scale in relationship to the adjacent developed uses. Scale: The project is well designed and architecturally blends into the neighborhood. Design: The building design is considered acceptable and interesting by the Architectural Advisor. Density: The project density of 2 unites per gross acre, is consistent with the General Plan designation of 3.5 units per gross acre and Zoning Ordinance. 5. Parking: The parking provided exceeds the code requirements. Compatibility: The project is designed to minimize infringement on neighboring properties. Design: The project is of high quality design and will be aesthetically pleasing Because this is a quiet, established neighborhood, the Commission finds that the additional Conditions # 9, #10 and #11 will keep undue disturbance in the neighborhood from occurring. Resolution 2669 Page 2 Based on the above findings, the Planning Commission does hereby grant the requested development, subject to the attached conditions: Se Revised Plans: Revised building materials, elevations and/or site plan indicating driveway dimensions and vehicle turn around to be submitted to the Planning Department and approved by the Planning Director prior to application for a Building Permit. Fencing: Fencing plan indicating location and design details of fencing to be submitted to the Planning Department and approved by the Planning Director prior to issuance of a Building Permit. Parking: Ail parking and driveway areas to be developed in compliance with Chapter 21.50 of the Campbell Municipal Code. All parking spaces to be provided with appropriate concrete curbs or bumper guards. Underqround Utilities: Underground utilities to be provided as required by Section 20.36.150 of the Campbell Municipal Code. Buildinq Plans: Plans submitted to the Building Division for a plan check shall indicate clearly the location of all connections for underground utilities including water, sewer, electric, telephone and television cables, etc. Garbaqe Service: Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single-family dwellings, multiple apartment units; to all commercial, business, industrial, manufacturing, and construction establishments. Property Maintenance: The applicant is hereby notified that the property is to be maintained free of any combustible trash, debris and weeds, until the time that actual construction commences. All existing structures shall be secured by having windows boarded up and doors sealed shut, or be demolished or removed from the property. Section No. 11.201 and 11.414, 1979 Ed. Uniform Fire Code. Site and Architectural: Site and Architectural approval is granted to construct a single-story, single-family home in accordance with the plan set sheets A-1 throuqh A-5 labelled "four bedroom residence for Todd Perry and Jerry HoUston, as redlined. Resolution #2669 Page 3 Applicant will control dust throughout construction period and after until suitable landscaping is in place. 10. The work hours will be from 7 a.m. to 6 p.m., Monday through Friday. 11. The applicant will ensure that all contractors and subcontractors participating in the building of this house, will control radios, loud noises, alcoholic beverages, and other nuisances. Section 21.42.100 of the Campbell Municipal Code provides that any approval granted under this Section shall expire one year after the date upon which such approval was granted, unless an extension or reinstatement is approved. Approval is effective ten days after decision of approval of the Planning Commission, unless an appeal is filed.
